Visa Waiver & I-130 Petition-urgent please

I am a permanent resident, with a 16 yr old daughter that lives in New Zealand with her father. Things have become extremely bad at home, her father is kicking her out and she has nowhere to go. She wants to come to live with me and obviously I need to get her here asap, or she'll be homeless, her fathers family and my family back there think shes acting out and wont let her live with them.

My question is: should I risk bringing her here on the visa waiver program and applying for the I-130 with the hopes that she wont be 'out of status' for too long before its approved. (I think current processing times are approx 5 mths) I did that myself when I came here and had no problems, I was out of status for a year before being able to process my paperwork.

Ideally I'm trying to find somewhere for her to live in NZ for a few months so the paperwork can start being processed first, but thats proving to be difficult.

If this were your child and she had nowhere to go - would you bring her here and file the I-130 knowing that she might go over her visa waiver time length?

From what I understand because she is understand she will not accumulate any unlawful presence because she is under 18..My daughter has been here for 3 years I am just now filing her I-130
