Hello everyone!

I have an a few annoyingly simple questions, i looked(skimmed) at the guides but i didn't see the answer.

my questions are;

Do I have to physically remain in the U.S. as I file for the IR-1 for my wife?

Can i live in the Philippines with her while the visa is being processed and once it's approved, move back to the states together? I assume this will require alot of mailing of forms..

please please help

Timeline

You may need to stay in the US till your petition for her is approved and then if the case is transferred to the US embassy Manila. Then that time you can go stay in the Philippines. That's what my fiancee did before after receiving the notice that the petition has been approved. He stayed in the Philippines and scheduled the medical exam and interview after receiving the case number. He just took with him all the necessary documents for the upcoming interview. Such as original tax returns, affidavit of support,telephone history, bank account history, pictures, letters and etc. Just anything to show proof of relationship.

They're going to need proof of domicile in the states. I agree that you should wait til the case is sent to the NVC, and proceed to the PI from there. Yes, you'll have to mail all of the forms, but it's up to you to decide whether it's worth the hassle or not. I'm thinking it would be. :)

a U.S. citizen who resides in the Philippines may be allowed to file the I-130 petition at the immigration services office at the U.S. Embassy in Manila. However, the petitioner must be domiciled or residing in the United States at the time the Filipino spouse has a visa interview.
