I'm preparing my AOS and helping my buddy's AOS as well because she doesn't have an internet excess.

My friend just married to USC and she has been overstayed since July of 2004. I just read from other thread saying that 8+yrs of overstayer might need a laywer. Is it true? Particulary for 8+yrs? Less than 8yrs will be safer than 8+yrs?

She doesn't have enough money to work with a lawyer so I hope I can give her good news.

Anyone went through like my friend or anying know about overstaying less than 8yrs? :help:

Please share your experiences or knowledge. Any feedback will be highly appreciated.

04/02/2010: AOS sent (I-130, I-485, I-765)

04/05/2010: delivered (day3)

04/12/2010: checks cashed (day10)

Have a friend who overstayed 9 years and just went through AOS process - successfully and they did not hire a lawyer. No questions about overstay or work w/o authorization were asked during the interview. Good luck to your friend!

As long as there are no other adverse factors, they should have no issues, as posted above.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.
