My wife just now filed I-130 with the California service center. I am in Canada studying full-time. I received a job offer sometime in March this year and when I accepted it he applied for my H-1b. This was prior to me getting married which was on 23rd of June. Now my I-130 is filed and I have my approved I-797 H-1b petition from the USCIS. Should I go for the visa at the embassy? Would they refuse me on the basis that I need to wait out the I-130 time-frame outside US. My employer is very keen to find out. I don't want to make a bad impression on USCIS or make complications on my case.
