I have a question,

My fiance is from the UK and I am a USC. We filed an i-129f in November 2009. We would like to visit each other as much as possible during this process. He visited me in December for Christmas. We are hoping he can visit again in March/April. Are there an limitations on how much we can visit one another while we are waiting for the k1visa? We are hoping his interview will be around May/June time.

Thanks for any help you can give!

No, you can visit him as often as you like - just carry the I-129F NOA1 with you and if they question your intent as a visitor, show them the UK Border agency the document and tell them I already applied for my fiances permanent residence in US. That should be good enough for them.

Also, do not offer any more information then required, if they ask why are you visiting? you can say something to the effect to spend my holidays away from work. There is no need to offer extra information but at the same time if they ask do you have a loved on here? do not lie, tell them the truth and show them the I-129F NOA1, provided everything else is good in your background I dont see why would they not grant you entry clearance.

Also, I would like to add it will be much easier and recommended for you to visit him rather then him visiting you because he is already in the system being shown as filed for a K-1. Hence, CBP officers can get really ####### if they wanted to - you can ask him to bring with him documented proof in case he gets grilled. Good examples include car parking receipt from UK along with the car keys (this one is super solid); a letter from the employer on the company letter head stating he will be back (another solid one); Housing/lease agreement.

But again let me tell you one thing about US CBP officers, they have every power in the world to still deny him entry even if he has all those proofs, it just depends on the CBP officer he gets to deal with. Hence, that is why I recommend you visit him instead of him visiting you.

Does that make sense?

Well, I am going to visit him but I can't take that much time off of work so we would like for him to visit me, too. If he has a copy of the NOA1 and a letter from his employer in case they ask anything, should that be enough? When he came in over Christmas he had no problems at all (and we had send the i-129f in November). I don't think they even really asked him any questions...was through really fast.

Any other thoughts?

Not really. Again as I said before it totally depends on the CBP officer that he gets to deal with, some are easy some are #######.

But again the key is don't offer any more information then asked.

Actually for him to show I-129F will cause more suspicion of his intentions, best thing would be just keep the talk limited
