I-864 issues - please help!

If this is the kind of over-simplified to the point of being incorrect advice you got from the NVC, then yes I do have a problem.

In the first case a Joint Sponsor will be required if the current income is below the threshhold (absent offsetting assets) no matter what the last 3 years income was.

In the second case a Joint Sponsor may very well not be required if current income is above the threshhold and the past income was below - a lot depends on why the past income was low and what is the source of the present income.

... In my opinion, if the petitioner's last 3 years' income is above 125% poverty level, then no co sponsor is needed. If the current income is above 125%, and if the most recent tax year's income was not above 125% poverty level, then a co sponsor is needed. Please call NVC and ask for their advices.

From my experience, I have found it out that the NVC operators do know what they are talking about unlike USCIS customer service people (whom some refer as misinformation line). Even you said, a joint sponsor may very well not be required, if current income is above the threshold.......and so on. What the concerned person needs to do is to be 100% clear before sending out the paperwork, whether he/she needs a co sponsor or not; the gray answer like "may" or "may not" won't work. I am only suggesting to call and talk with NVC to see what advice the petitioner can get from them. I have been dealing with NVC since early 2005, as I successfully petitioned for my parents and now doing it for my wife and my paperwork made it through the NVC and Embassy very well. A phone call to NVC does not hurt. I am never saying that someone should follow my advices, it is people's choice to make up their minds. I am merely expressing my opinion here. Believe me, I have been helping lot of people with the NVC process and they appreciate it as well. They never complained about incorrect advices from me.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

I am in a similar situation. I have filed taxes since 2000. Only once it was 125% over poverty line. My current income is above 125% pov. line. A letter from my employer, recent paystubs, bank statement can show my current income. But a strict CO may always think that this new job could end any day.Having a co-sponsor is good, just to be on the safe side. If you have a co-sponsor, the worst thing that can happen is that CO says, your own income is good enough, you didnt need a co-sponsor and puts joint AOS on side. But not having a co-sponsor in this situation is not a safe way. Better be safe than sorry!!!!!
