i really thank each of you for your kind attention and advices

i admit we have had a kinda " weird " relationship (me and my wife) - simply and to make it more clear we are just trying to give ourselves a second last chance & it's really a brainstorming situation - we just hope it can work out for us again and to find ourselves supportive to each other when in need as we promised when we decided marriage - sometimes people are more brittle than they think they are and mistakes happen and will keep happening to people every single moment - the most important question is how willing are we to face our mistakes and make some new arrangements to go on with life...

hopefully i can give some feedback soon and wish there is any chance to pay you back your favor if i could :)

Good luck to you all

Your wife can file the IR-1 and provide only the truthful information in the application . You are legally entitled for the petition since you are legally married but as for the effect of the "mistake" made by your wife is another thing. As you have said you both wanted to give each other a chance and hoping that this time it will work out to both of you.

Just tell them the truth, don't claim the child as yours coz the child is not really yours. I guess it's just a matter of proving to them that you are both willing to straight things up. Besides, if you will be approved for telling all the truth then it is a sign that you are meant for each other. And if you're wife really meant to give your relationship a second chance, then she'll do everything to have you back, and not just by naming a child to you. Good luck to your journey.
