I-134 Question regarding employment letters.

Timeline

My fiance and I are ready for our interview on January 19th. We feel like its so timely because he will start working on the 11th of January.

He recently got Letter stating his conditional offer of employment. It states it's full time, he starts work January 11th and states the pay rate of an hourly salary of $XX.XX.

Is this enough proof to give to the colsulate, or will we need more? If it's a conditional offer, will it pose an issue if it's not stating he works there now, but a conditional offer?

Do we have to submit paystubs or will a 2008 Tax Return/W2s be enough? Will a 2009 tax return be needed for a January 19th 2010 interview be required? He has yet to file his taxes for 2009 as of the interview date.

We just want to make sure there will be no reason for our case to undergo administrative reviews. We just want to be together for valentines day.

Besides the letter of offer for employment, I think it would be good to have on hand with the I-134 your fiance's previous employment pay stubs and tax returns for the last 3 years prior to 2009. Remember the I-134 is to prove to USCIS that your husband has sufficient income to support you during the 90 days you have to get married so you do not become a financial burden to the US Govt., such as welfare system. The more you can provide concerning his previous employment and income for the past 3 years the better in my opinion. The economic situation and unemployment situation in the USA is not so good right now that is all the more reason to provide the past 3 years of employment and income records.

It is difficult to provide you with an exact answer since you have not provided enough background information. How long were you in school and did not work? did you work prior to going to school? If so for how long and can you provide income records for that period and also provide documents proving you were in school full time for you were unemployed?

I have my 2008 tax return, I haven't filed my 2009 tax return yet because it's not 2010 and I need to send the paperwork to my fiance (Original poster) early January. I have been unemployed since I visited her in April, which is a good thing since I spent 2 months with her instead of 3 weeks. I got a job and it starts January 11th, our interview is on January 19th. I just want to make sure that not having a job for a long period will not be an issue, or if we will get denied for not having my pay stubs/long term employment. Also, all I have is a letter that is an offer of employment stating the date to start work, how much my pay is and stating it's full time.

Will these be enough? 2008 Tax Return, 2008 W-2s, I-134 and a letter stating I have a job offer?

If logic plays any roll in this then its "current employment" that really counts. I'm sure past employment is also an indicator, but what you are earning now is a clearer indication as to your ability to support your fiancee. JMHO

I am having a co-sponsor but I am including mine and my parent's I-134, both our employment letters(it is required), last 3 paystubs, 12 months of bank statements and 2008 income tax papers. I asked my agency about the same question you have and they just said it's only necessary to present the most recent tax return of 2008. Since the law states that W-2s dont have to go out until AFTER your interview date, there is no way they can expect you to have those 2009 tax returns.
