Hi fellow VJ's, just wondering if i can use my old passport as one of the requirement in filing a CR-1 Petition. With my old passport, that is still my ex - husband's surname. Can i just use that as one of the requirement then just change it to my new married name on the NVC process or interview? Will that not cause any problem? and with the G325A Form - i use my newly married signature already....I appreciate your immediate answers. God Bless

How long ago did you get your passport. A copy of your passport is not needed at this point unless you are a US citizen...even then you do not need to give a copy of it...just a copy of your BC. You can get your passport updated while waiting. You will need to get your name changed on your passport before you get your visa though. But in the PI, that should be a fairly easy task (if you are the one from the PI...you didnt specify in the post) On your G325 use your new married name.

16 March 2012 Sent I-751 package from Aviano AB, Italy.

29 March 2012 Received everything back...wrong fee. thought we didn't have to pay biometrics since we were sending fingerprint cards and passport photos.

30 March 2012 Sent everything out again from Aviano AB, Italy.

10 April 2012 Check cashed

17 April 2012 Received NOA1 dated 6 April.

06 Dec 2012 Received 10 yr green card. Letter said it was approved 28 November 2012.

Hi there Scott and Mhay, I am referring to my Philippine Passport, it expires next year (Aug 2010) but still i insert this to the petition, will this not cause any problem (since the old passport is still on my ex - husband surname) but in the G325A Form that i send, i already use my New Married Surname Signature. If I applied right, i didnt include a copy of my wife's passport in the application. (i didnt see where it was required) I would just renew your passport now since you will have to get it renewed before they issue you the visa anyway. It's best to have it all correct. I know my wife hasnt changed her passport yet. She is waiting for me to come back to the philippines so i can go with her. If our petition goes quick, i will just have her go apply to change her passport.

here is the list i put on my cover letter to the petition:

1. Check in the amount of $355 for petition fee.

2. Form G-1145

3. Form I-130

4. G-325A Biographic Information forms for petitioner and beneficiary.

5. Color 2x2 photos of Petitioner and Beneficiary.

6. Evolution of Relationship

7. Copy of U.S. Spouse's Divorce Decree.

8. Copy of U.S. Spouse's Passport.

9. Copy of U.S. Spouse's Birth Certificate.

10. Copy of Certificate of Marriage.

11. Copy of beneficiary’s Postal ID.

12. Four Affidavits as secondary evidence of Bonafide Marriage.

13. Copies of identification from people that completed Affidavits.

14. Copy of wedding invitation. (2 pages)

15. Twenty-one (21) pictures from wedding as secondary evidence of Bonafide Marriage

I would definately get your name on your passport changed as you will want your visa will be in your married name...If you need a copy of your passport, it is just that a photocopy at this point. You will take your passport to your interview. If i misunderstood the instructions, then i know i will be corrected. I did read the guide and the instructions for the I-130 a couple of times.
