I am preparing the I-864. I am the sponsor. My income easily meets the poverty guidelines so there is no need to include my spouse's income. In fact, as she was in school the past three years, her income was only about 3% of our total household income each year. However, if we filed our federal tax returns as married/jointly am I required to include her as a sponsor and have her complete an I-864A? Otherwise, the answer to Q25 (Adjusted Gross Income on 1040) on the I-864 will include her income and will be higher than my income as reported in Q23 and Q24a.

Help! Thanks!

You do not need to have her do the I-864A. You just need to list on the I-864 your income as listed on your w2's. I did not include my husbands income on my I-864 because I earn enough on my own to sponsor both my parents. For Q25 I put the amount of income I had as stated on the W2.

This was accepted by NVC and London Embassy.

Out of interest, did you send photocopies of your tax return and supporting documents or did you send a transcript? And did you just send last year's or elect to send three years?

I sent tax transcripts for the last 3 years. It was easier to send the transcripts than the actual returns with the the w2's and schedules.
