Hi!

I looked at the guide for getting a social security card, but i'm still confused about something. Question 3 on the application has 2 boxes we can check "legal alien allowed to work" and "legal alien Not allowed to work." My fiance came on a k1 visa, but didn't get the work stamp on his 1-94 and didn't get an EAD yet. Does anyone know what we should mark?

K-1 Adjusting status

March 2nd 2006- we got married!

April 26th- AOS & EAD papers sent to chicago lockbox

May 2nd- NOA1 issued

May 10th-touched!

May 25th-appointment letter for biometrics sent out

June 17th-biometrics-completed!

June 20th- touched!

July 27th- EAD approved.

August 10th- AOS interview!! Approved! Alhamdulillah.

"legal alien allowed to work" if he has has not been in the U.S. over 76 days. SSA considers a K-1 authorized to work for SSN purspose. If he has been here over 76 days he will need an EAD card or I-551 stamp or card to be assigned a work authorized SSN and in the meantime he can apply for an ITIN from the IRS if he needs a number to file taxes.
