Hello everyone! We are almost ready to file for my AOS and I am just double checking all the forms. My dilemma is this - my husband (who is sponsoring me) is an independent contractor, so he has no set income. It depends on the jobs he does. His latest tax reform says his gross income is only $5,000 after all the deductions like mileage (he drives about 40,000 miles a year) and other expenses - obviously we are going to get a sponsor who will file I-864A.

Now, what do we write for "current annual income"? He doesn't have a direct employer per se, technically he works for himself (jobs are sent to him via a dispatcher). We have his pay stubs and they range from $1,700 - $2,800 each month but I don't know if I should base his current income on this (get the average and multiply by 12), since next tax season he will have to list all the deductions again and will probably end up with the same number for his gross income, or even less, given the way the economy is...

Sept 10, 2009 - Received EAD card

Sept 17, 2009 - Received Greencard. Woohoo!!!

You list gross income BEFORE all the deductions. So it will be MORE than $5000.

And yes you take income to date, and average it to estimate Gross income for this year.

If you use a Joint sponsor, the joint sponsor also uses an I-864, NOT I-864A.

I-864A is to allow a member of the sponsor's household to add their income to that of the sponsor to bring the sponsor up to 125% poverty line. Example: A K-3 enters the USA and apply for EAD and then gets a job, the K-3 spouse can add their income to that of their sponsoring spouse and the K-3 would provide an I-864A.

Thank you for your reply YuAndDan! And thank you for the links, I could not figure out where to edit my info yesterday.

I double checked his tax return, and his total gross (not adjusted) income is just that - $5000, on line 22 on his 1040.

So even with this being the case, should I still go ahead and get the average on his pay stubs to get his current income for this year even if there will be a huge discrepancy with his total income from last year according to his tax return?

I failed to mention that his brother will be the co-sponsor, and we all live together in one house so he would be filling out the I-864A. But on this note, can he be a JOINT sponsor and fill out another I-864, even though we are in the same household? I did read that they would have to provide proof that they are brothers and they are not sure if they have their birth certificates, and it would take time for them to get these (they are naturalized citizens so they would have to get their birth certificate from their home country) I don't know what else could count as proof. Sorry if this is sounding too complicated :wacko:
