Okay I replied to a thread earlier asking about this but the thread died before I could get an answer... now VJ won't let me search my posts, grrr.

Anyway, my fiance is visiting next month and since we have already filed the K-1 petition, we know there will be problems at immigration.

Ash is currently unemployed so we could not use anything for an employer. He also still live at home so he could not use a lease statement. He definitely has reasons to go back i.e. completely visa process, family, etc. He also has a car insurance bill and phone bill to pay which some have said won't work because he can cancel those. Also, he could also have bank statements showing what he has over there.

I will obviously send him a copy of the NOA1 to show and flight itinerary showing a return ticket, but is there anything else he can do? I know it would probably be hard for them to believe he has to go back when he doesn't have a job or lease agreement.

My fiance is from the UK, too. He came over in February, about 2-3 weeks after we filed our I-129F. We had Mark's boss write and sign a letter saying he had a contract of employment to fufill and so he had to come back, but they actually never even asked to see it. They asked what the purpose of his visit was and he said "to visit my girlfriend", and they said "Ok, have a nice time!" and that was it. So...as long as your guy doesn't stand there in front of the agent and say "I'm coming over to help plan our wedding!" or something else to indicate clearly that he will EVENTUALLY be coming into the US to marry, he should be fine.

Also, for the record, Mark comes in through Boston, and they never give him any stick.

Our Timeline

11/2001 - met online

6/2006 - first face-to-face meeting (he's been over 7 times total since then).

1/26/09 - filed I-129F with VSC

1/27/09 - package rec'd, NOA1 sent

1/30/09 - NOA1 hardcopy rec'd

1/31/09 - touched

4/29/09 - NOA2 email rec'd from CRIS! YIPPEE!!

5/12/09 - Mark rec'd Packet 3

5/29/09 - returned packet 3

7/12/09 - resubmitted packet 3 after being told for weeks that it was never rec'd

8/19/09 - interview scheduled for 9/11/09! Medical moved to 9/10/09.

9/10/09 - medical - passed

9/11/09 - interview - approved pending embassy receipt of medical results!!!!!!! Hard to believe it's finally done!!

10/2/09 - POE: Logan Airport in Boston, MA. Absolutely no problems, aside from the customs official not knowing what to do with the visa and having to find someone to help.

10/10/09 - Married!! :D :D :D

12/2/09 - SSN applied for in Montpelier, VT

12/7/09 - SSN received in the mail - that was fast!

1/9/2010 - AOS & EAD package sent

1/15/2010 - NOA's received for both AOS and EAD applications

1/22/2010 - biometrics appointment letter rec'd - appt is for 2/2 in St. Albans, VT.

Well from what I hear it's best to tell the truth anyway so we are going to say fiance. Also like I said, Ash doesn't have a job so we can't actually use a letter from an employer.

Seriously, do not make this harder for yourself than it has to be. You are not legally obligated to say fiance; my husband repeatedly referred to me as his girlfriend out of force of habit in the months leading to our wedding. Are you not still his girlfriend as well? Is he not going on holiday? Volunteer only as much information as is necessary -- don't start gushing. Do not assume there is going to be trouble at POE -- more often, waaaaaaaaaaay more often, than not there are no issues whatsoever, no documents besides a return ticket are requested as proof. If having an NOA1 or some bank account statement makes him feel better, then take it along but he shouldn't proffer them unless requested. If he is confident and treats this as a formality, some CBP officer is less likely to sense something fishy on his radar.

Remember, there are many, MANY more people out there who are not on VJ and who visit their loved ones in the US on the VWP and are not packing "proof" when they get to the border. He should use his common sense and not make a song and dance out of it.

I visited my fiance 4 times while in the process

I did take a letter from my boss saying that I was returning back but never had to show it I have only ever been asked for the copy of my return ticket.

Also I never mentioned fiance, I just always said I was visiting my boy, which is not a lie, it is just terminology

I wish you luck I am sure it will be fine
