Ok folks, I have questions for AOS.

Husband came on K3 visa 6 months ago. However, his I-94 is going to expire on June 2009. The notation stated that his stay is limited due to his passport expiration. We have just renewed his passport and are preparing for AOS. What will happen if we send his AOS paperwork before his I-94 expires? He does not plan to travel out of the country until he gets his green card. Is he going to be out of status? Where can we be able to extend his I-94 without leaving the country?

If you send it before the I-94 expires, it "freezes" his status as soon as you get the NOA.

So it's a good idea to AOS ASAP.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

I totally agree with Bobby. The best for you is to file your husband's AOS ASAP (Of course before I-94 expires).

Your husband doesn't want to be out of status. Why are you waiting for ? Life is short !.....

HERE IS MY TIMELINE :

I-130 mailed 01/13/09

I-130 received by USCIS 01/16/09

NOA1 Mail for I-130 received 01/22/09

I-485 Package mailed 02/17/09

I-485 Package received by USCIS 02/20/09

NOA1 Mail for I-485 & I-765 received 02/26/09

NOA2 e-mail for I-130 Approval 03/03/09 (47 Days)

NOA2 Hard Copy of I-130 Approval received 03/07/09

Biometrics Done 03/24/09

STILL CAN'T SEE ON-LINE STATUS FOR AOS & EAD !.....

NOTE : I DID NOT APPLY FOR I-131 (AP).

Not enough financial resources to start the I-485 process..... and joint sponsor for I-864. Our consular process involved a very draining I-601 waiver. I want to make sure that the info I found from official sources is consistent with the experiences from some members of this site. I want to make sure my husband won't get in trouble if his I-94 expires while his AOS is pending.
