I'm a Legal Permanent Resident of the U.S.A...me and my husband with our kids are planning to travel back to the PI for a long term stay of more than 1 year. We will file the I-131 for Re-Entry Permit long before we leave.

Our question is...How long can a Green Card holder legally stay out of the U.S.A as long as their Green Card is up to date?

Also, I am trying to find out if I can renew my Green Card online while in the PI and have it sent to the address in the PI?

Any info regarding this question will be highly appreciated...Thanks and God Bless!!!

I suggest you file a re-entry application. Normally the LPR's status can be reviewed if they stay outside the US longer than six months. A year will definitely cause a problem.

Yah,im going to apply for a re-entry before we planned to leave coz that's what I've read when they sent me my Green Card and it states there that if I planned to leave US for more than a year I need to apply for a re-entry before I leave...

What I just dont know is that,what if we want to stay there in PI lets say...2 years or more?

When I apply for a re-entry before I leave,will they let me stay in the PI for at least 2 years or more? Or,they'll limit the duration of my stay there in the PI?

At that point I would say the LPR has abandoned his status. Why not just file for citizenship and once that is awarded file to reinstate the Filipino citizenship and all is well :blink:

You might want to double check the info I give you, it sounds like it makes sense but u want to check it out....say you plan on staying there for over a year...........you can take a trip to Guam or Hawaii every six months and that gives u the re entry to the United States. Then u can go back to the Philippines .......hopefully u can afford this LOL! ........again check out the permit if your stay in RP is more than 6 months. My friend told me this again check out ur options and good luck..... :blush:

Permanent Resident card received 11/05/07 (dated 10/31/07)! THank u LorD!

Will file for 10 year GC End of July/Early August 2009!

Removal of Conditions:

Mailed I-751 overnight mail to Vermont Service Center 09/10/09

VSC received the I-751 Packet 09/11/09 About 12 pm Local time

Check was cashed as of Sept 16th 2009

NOA Received 09/19/09 dated 09/14/09

I-797 Appointment Notice received 10/01/09 dated 09/25/09 (Biometrics)

Got they 10 year GC approval letter in the mail dated 01/08/10! yehey!

10 GREENCARD RECEIVED 01/20/10

Citizenship.......maybe............or maybe stay a permanent resident .......................

i was watching this show at TFC one time last week and they were talking about this issue.

i think the lawyer's name was gurfinkle or something (forgive me for the spelling) but if i remember correctly, if an LPR stays more than a year (or a year) out of US (in PI or anywhere), it will simply mean (even if it doesnt) that the LPR is abandoning his status to legally live and work in the US.

i think it is best that you talk to somebody who has a vast knowledge on this issue or better yet an immigration lawyer who can expalin everything to you before you leave for PI. this way, you guys can avoid any mistakes. :-)
