if child follows more than one year after your K-1 is issued, then you will need to file a

I-130. k-2 benefits expire after one year.

even if you choose to have child come after two years, still check follow to join. you would still have option for a k-2 if you later decide to have the child follow sooner than two years.

yeah i understand that part where the child automatically gets derivative status, effectivity of which expires after a year...

but for sure we are not going to file within that year, he is 11 right now, we are thinking 13-16 would give us enough time ... being that the case, i guess your opinion would be to check the Yes box.

hi guys maybe someone can help me. i guess at this point im kinda lost and would like to know peoples experiences with regards to having their children follow later on in the future (not as a derivatory status).

in filling out one of the forms, i cant remember which i think it is DS156K, there is a question there asking to name the children of the fiance. the following questions are "accompanying you?" (which i answered no to since there are still things that we have to fix with regards to childs b/c) then there is that question which asks whether the "child to follow"...

my question is, well we are planning to have the child follow here if he wills it that way but right now, we have decided to wait a couple of years. What will be my answer to the question that asks "to follow?"

I hope someone can help me... thanks guys, you have always been of great help to us... :D

check the yes box on follow to join. leave the option open for a K-2

YYB - You can put none for the question #34 "Name and Relationship of persons Traveling With You." Per the Department of State (DOS), "The child may travel with (accompany) the K-1 parent/fiancé(e) or travel later (follow-to-join) within one year from the date of issuance of the K-1 visa to his/her parent. A separate petition is not required if the children accompany or follow the alien fiancé(e) within one year from the date of issuance of the K-1 visa. thanks uling. thats how i was planning to do the DS-156 but if you look at DS-156K, number 5, that is where it gets confusing. i was thinking the answer should be no since k2 will not be applied but the phrase to follow is not clear, i mean he CAN follow in 3-4 years but either as a visitor or another petition like you have mentioned above

hi all. we just got an email from the nvc that they recently send our case to the embassy. i know there are peeps who's still waiting before us but is it safe for me to say i'll get a late dec. interview or early jan? and i dont know how it goes when they have our case already, would they send me (the beneficiary) a postal mail that they got our case? thanks. just confuse

Yes, Manila Embassy will send you a postal mail 2-3 weeks from now.They will inform you when they receive your papers and what other papers you need to prepare for your upcoming visa interview.

Does anyone have any insight or thoughts or words of wisdom? They are not saying it is in any status.... and I know we had no issues with any requirements... plus we submitted about 100 pages of evidence to support the petition.

they did not say you are on AR? sometimes AR can mean further verification on the Philippine national. i think i read somewhere here that another couple had this too...since she had a kid...or they had some issue with the BC or CENOMAR. i'm not sure but i read it in pinoyinfo.net forum.

PW, we tracked it through DELBROS and as of yesterday it says it was out for delivery. we'll keep you posted. he hasn't done his CFO seminar so it would be great if the visa arrives thursday. we haven't even made travel plans at all...pending the visa. :unsure:

When Janice asked the embassy they said it did not have a status yet, it had not been reviewed.... 10 days after the interview. She submitted clean CENOMAR and NBI and Police certificates... very very strange... I just hope we get the visa soon...or at least a status at this point... the waiting is awful.....

Anyone here know exactly what papers the NVC sends with ds-230 for the philippines. We are doing the cr-1/cr-2 and just paid the IV bill....we should be able to send the ds-230 next using the short cuts but i'm not sure exactly what papers to send as the philippines is on there list of countries that need the part 2...so if anyone has done this step and can tell me exactly which forms and documents i need i'd appreciate it.

I sent DS-230 part I & II. Part II not signed. I don't recall offhand what other documents were sent, should be in instructions. Isn't that the one that requires birth certificate and maybe marriage certificate? If nobody else answers, I'll check later. I just got home from a crappy business trip, need some rest...

Be the one to call the embassy at (63-2) 528-6300 ext. 5184. They give more details if it's the US citizen calling them.

Someone asked a few pages back about recalled IMBRA petitions and interviews.... I was one of the recalls, and I just received my fiancee's interview date (November 2) online. Which is pretty quick considering NVC sent our reapproved petition back to Manila on August 30. So any recalls who have their petitions back in Manila shouldn't worry about any further delays... it seems maybe they really did put a priority on our petitions to get us back in the queue! No packet yet of course...I'm hoping the relatively fast turnaround of the petition won't interfere with the packet arriving promptly, since my fiancee's medical is only 5 weeks away.
