Hi PW,

thanks for the replies ..... your really helpful.

we did check the website , and as K1 so i need to do this???

(1) filled up infosheet filipinos marrying foreign nationals ... and then with this infosheet:

(2) submit report to marriage contracted here in US to notify CFO and civil registry too that im married and need to pay $25 for that form, and pictures and originals documents like marriage cert.

(3) submit ammendment of phil passport for married name, and pay 32pages of new passport for $50 and pics and submit originals as well

and we need to pay courier for sending all application and fee to send all originals documents to us along with my old philippine passport and new passport in married name. and security of getting back all documents depends on courier... thats tough :blink:

PW hello ! sure i can add to the timeline but im affected by IMBRA... sadly. :( i dont fall into any of their categories or rules but since i applied after march 6. (darn missed it by 3 days) im still waiting for my NOA2. this is depressing :(

Hi Jazzy,

The Certificate of Finality is not issued by the Office of the Solicitor General (OSG) but is issued by the same court that granted the petition. What the court does is to wait 15 days from the date the decision is rendered to give the OSG time to file any opposition. If the OSG does not oppose within the time frame, the Finality is issued. The communication is internal between the court and OSG.

When I told the court clerk that I was going straight to the embassy to submit the decision, she told me not to waste my time because the embassy would still require me to submit the finality. She told me of similar cases before me wherein the embassy sent the ladies back to court to wait for the finality. I just took my chance that the embassy might not require it from me since I had a finality for the 1st annulment. I hope I get lucky :yes:

It is not imperative for Filipino citizens to report their US marriage to the Phil. Embassy but if you want to amend or renew your passport, the report then becomes a requirement.

If I were in your shoes, I would just wait for my EAD to obtain an ID with my married name. Amending or renewing the passport is complicated and expensive. Maybe you'll receive the EAD in a few weeks.

With all due respect to your lawyer, the OSG cannot issue a Certificate of Finality since it is not the one deciding the case. Only the court has the power to do that. As a matter of fact, the OSG is a party to the case as they represent the government (thru the City Prosecutor/Fiscal's Office) in all annulment cases.

I can only assume that what you have is a Certification from the OSG. "Procedures require that an Order be issued by the court directing the OSG to issue a Certification briefly stating its reasons for its agreement or its objection to the petition within 30 days from the receipt of the order. This is in accordance with the decided case of the Supreme Court, Rep. Vs. Molina GR No. 108763 Feb. 13, 1997." http://philsprocedure.blogspot.com/

After which the Certificate of Finality together with the Decision, and a copy of the petition will be submitted to the Local Civil Registrar. Make sure that your annulment is not "half-cooked".

I suggest for you to double check the above facts with your lawyer. This may just be a simple misunderstanding as legal jargons can be really confusing. Let me know what your lawyer says.

My wife was not understanding the papers correctly. You are correct and the papers are all in order....the finality came from regional trial court where the case was heard after the OSG's 15 days were up. The only paper we are waiting on is from the NSO to be sure it is registered with them...but everything seems to be completed properly as you have outlined above....:)

Good news this week, we are on the last step of getting her BC corrected :D GOing to try to call the Embassy tonight. Just wondering if they still take calls thru the main number or am i going to have to pay the 18 bucks and not get very good info :( Anyways, we are praying that we can get a interview date for late August. :thumbs::dancing:

Hey wind, once your fiance gets the BC, you don’t have to wait for August interview. You may want to send a fax to the embassy to inform them that she is now ready for the interview and if they could set a new interview date already. I’m sure the embassy will queue her ahead once they receive your request. You’ve done time already by waiting to be scheduled in February, it just so happened she wasn’t ready with her documents. Remember though that embassy won’t probably inform you once they approve your request. What you can do is to check the interview schedule in their website every now and then. If I remember correctly, this was how john_and_marlene found out that their request for a medical expedite was approved.

I prolly should have done this but it was hard to tell when it was going to be done...still is. I called them tonight August is all booked up :( I need to send a request for a interview date, i think i'm going to send a early request form also and try to get it for late August. If we don't i guess we just get it for Sept. :clock:
