hello i have problem to my BC MY FIANCE

here bc nothere name and he told me he change name many years ago but

its just ok if i bring here bc useing old name or i ned some proff about he new name

but the f-129 he put there he have nother name and he said no problem about that

guys i need your advice thanks u so much ...

Your fiancee must make sure that her birth certificate had already been corrected at NSO. If i were you, advice her to follow on what is the correct written name in her birth certificate.

In my case, my school record and government record shows that my name was " Maria " , (i was using Maria since birth) When hubby applied for my K1 visa, i found out that my birth certificate wrote as " Marian". I asked advice to a lawyer, he advice me to just follow on what is the correct name in my birth certificate. I dont like to changed my name so i went to our local civil registrar and asked advice also, they told me i can use the name "Maria" but i need to file for a change of name for correction. And a name to be corrected , will take a long process and a lot of money. It should be published for six months or a year before it all done.

So, what i did i just follow on what is written in my live birth... and it worked so smoothly. Since your fiancee telling you that her new name has no problem, i think it was already corrected. So maybe she is good.

You have a problem with your fiance (USC) Birth certificate (BC). It shows a different name, not the name indicated in your F-129. And he said there is no problem with that.

You are asking if you could just bring his birth certificate with a different name or if you need to bring additional proof of his name change.

Just want to know if i understand your question...

I would suggest, bring his BC with additional proofs on his name change. Do both.

ENGLISH TRANSLATION from her other post:

I have a problem, my fiance's name is different from his Birth certificate name.

i asked him about that and he said he changed his name long time ago. im confused and afraid that i'll be questioned by the consul during my interview.

What will i do? my fiance told me that it's alright to change name in US and there is no need to change the Birth certificate, but, in form F-129 it was asked there "other name before", and he answered none.

what will i do? what do i need to do about that?

I think she is from cebu, she might know bisaya than tagalog.

If she writes in bisaya, and someone translates her question to english or tagalog... it would be easier for us to help her.

I think it would also be good to correct the I-129 to include the name used on the BC...

You have a problem with your fiance (USC) Birth certificate (BC). It shows a different name, not the name indicated in your F-129. And he said there is no problem with that.

You are asking if you could just bring his birth certificate with a different name or if you need to bring additional proof of his name change.

Yes it could be possible that this might be part of the question during the enterview. If it is true that his changing of name has no problem...I think, you need to know the reason why he changed his name, so that you know how to answer the question just in case. If that reason is acceptable , maybe you will be good.

Just want to clarify if their application was been approved. If it was already approved, then she might nothing to worry about, it would never been gone to Manila if his fiancee is not yet cleared here in the USA. Before an application approve they do a background check here.

What she need , are those identification that her fiancee was been submitted in their applications. If possible she must all the copies.

Oddly enough, I just found out by doing a google search that people in the United States are allowed to change their name whenever they want to (as long as it is not used to commit fraud) and it doesn't even have to involve any legal paperwork. Names can be changed in two ways:

1) by picking a new name and using it consistently. This is called "common usage".

2) going through a formal or legal process

Yes, i beleived that his fiancee did not commit any fraud, since he already met his fiancee in the Philippines using his passport in his new name. Only my own opinion.
