please guys, i need your advise or your experiences.. did you choose file married filing jointly or married filing separately.. i dont have US income yet.. what did you guys do? for last year? what happen? for this year?

I don't think you can file until you are working.

its a no brainer since you had not income. File Married Jointly. You do need to file just to help your AOS interview case later.

A bit more info. Since you were a part time resident in the US you need to follow the instructions in IRS Pub 519. Essentially your eligable to fill as a full time resident as long as you and your husband agree to be taxed on your global income and sign a statement which is outlined in the Pub. So you do have this to consider. So this woud come into play if you made significant money in 2008 when you lived in Phil or if your husband made money in other countries or was treated as an expat.

thanks.. i now have the information (tax reports) or 2316 from the company i have worked for the tax year 2008... and will jsut do a trial and error on which choice will we make ..:D should i file for 2555 too?

hi i did work til sept 08 but i never bothered declaring it here. it did not cross my mind actually until i read your post. my husband's dad who works for H & R block will do his taxes and he did not ask me about my income in PI so I assume that there's no need for me to declare it.

hi i did work til sept 08 but i never bothered declaring it here. it did not cross my mind actually until i read your post. my husband's dad who works for H & R block will do his taxes and he did not ask me about my income in PI so I assume that there's no need for me to declare it.

know what.. its just a lot of work to do but it will eventually end up with one thing its still going to be ecxluded i think i have read the form 2555 my income didnt reach $87,500 together with my rent and stuffs same result... hay...

3.15.2014: Mailed I-130 Packet for Mom and Dad

3.21.2014: Received email notification with case # for both petitions; case forwarded to NBC for processing

3.21.2014: Check cashed

3.22.2014: Hard copy NOA1 received

4.08.2014: Both I-130 approved (notification received via email) - It only took three weeks!!!

4.11.2014: Received NOA2 approval notice in the mail.

5.01.2014: Called NVC to ask for status of paperwork. Advised they received both application on 4.28. Advised to call in 30 business days for an update.

6.02.2014: Email notification received from NVC that shows parents' NVC case number and instructions to pay AOS Fee and fill out DS 261.

6.03.2014: Paid AOS fee ($88 for both petitions)

Your income in PH has nothing to do in US Tax, probably pay your tax to PH BIR not in US. You have no work here yet nothing to declare here.

this statement helped me a lot and now i know what to do.. so wont get in trouble.. this is not an opinion, just going by the book... thanks guys for sharing..:

I've mailed mine. It included in this order:

* Subsitute W2 Form 4852 filled out and signed by the one with foreign income.

* USCs W2s attached to front of 1040

* Form 1040

* Schedule B & D (you might not have these depending on your income)

* Form 2555EZ Foreign Earned Income Exclusion ( I did the pdf version from irs.gov where you can type and save and print)

* Statement: Nonresident spouse treated as resident signed by both

You could have different Schedules, like Schedule A if you itemize or other forms that fit your return so my list is not what everybody would have. Bolded items you would have most likely. I chose to use the 2555EZ from the IRS and took out the 2555 printed by TurboTax because it was a shorter, easier form for people not taking a housing exclusion. I flled it in on TurboTax to do the exclusion but traded forms for mailing. There wasn't an EZ in my version of TurboTax.

There's always free TurboTax online if you want to give it a run through to compare totals. I came up with the same number on both free online versions. Wouldn't be a bad idea to check yourself since this is a complicated tax year. TurboTax wil let you move forward without info being completed.

Edit: Forgot to say, no actual UK documents were sent as "proof" of income. Just the subsitute W2 Form 4852.
