i need help about my visa

my hubby filed in I-130 last october.but we got confused because i read on some websites that IR-1 is applicable only to those couples who've been married for atleast 2 years.n that my hubby needs to file another packet of papers before that gets approved,called I-129f.but he said that's a fiance visa paper.

we've been married for 7 months now n i have a kid from a past relationship n i would be happy if im gonna be able to take her with me to the states....

pls help! tnx in avance!

Probably best not to file the 129 this late. just ride the I130 to a CR1 visa. Cr1 is married less than two years....

CR1 takes about a month longer, but it is a much better visa.

You have two options..

First is to file I-129F and pursue K3. You could take your baby with K4.

Second is to pursue CR1 for you and just file another I-130 for your kid.

The 129f is for both K1/K2 and K3/K4 visas; fiance/derivative (child) and spouse/derivative (child) visas. If you do decide to go the K3/K4 route be absolutely certain to include your child on the 129f.

Have you already filed an I-130 for your daughter?

I-129F Both petitions were approved all at the same time.We were on a K3,K4 visas,everything went smooth only it took long but we're already here in the US.
