Need advise on what to do...I met a women in philippines and we want to get marryed.But to make a long story short.She got marryed to a guy from a diffrant country a few years ago.He went back to his country and met a nother women and never came back.And a anullment takes a long time in the philippines and are expencive. So dont think i can bring her hear on a k1 visa.because she still marryed in that country to a guy in a nother country..Any comments that will help ?

For you to be together whether here in the Philippines or in the US, she needs to file for an annulment in order for her to be free to get married again.There are annulments that can be done in a matter of 6 or 8 mos but you have be ready for the cost.

Annulment is the only way to go if you ever want to bring here to the states. In order for you to be able to petition a fiance she must be legally free to marry aka legally single. if you marry her in phils she must be her only husband aka be married to one guy legally. Anullments can take 6 month to 2 years and from 600 dollars to 2,500 dollars in costs. Usually the more exorbanant fees in bribes to the judge the faster your case will speed along.. but either way anullments are very painful and it isn't garanteed of being granted.. If you want to go through with it get your honey in the phils to search for a good attorney to do your anullment case and just sit tight. That's all you can do I wish you the best of luck hopefully its fast and cheap. Hopefully you two will have it easy and can finally be together

Good example for pinay to do K1 visas and NOT marry foreigners in the Philippines. Petitioner can split on them. be already married, or die leaving the pinay hung out to dry . Hard for them to move on with their lives without a expensive annulment.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

There is not much you can do without the annulment. In the Philippines, the consulate does their own background checks on the beneficaries (the person being petitioned). If they find out that beneficiary is married, that is an automatic denial.

I know annulment takes a long while and is expensive. But that's the reality of it. Why don't you just enjoy being engaged while waiting for the course of the annulment? Before you know it, their marriage is already annuled!

Annulment of her marriage is the best you can do. She can't marry you in any way if she is still married to someone else.

If her foreign spouse files for and is granted a foreign divorce, the Philippines will recognize that divorce and she can have her NSO record annotated to show she has regained the capacity to marry again. She must not be the petitioner for that divorce though--it is only recognized if it is the foreign spouse that files for the divorce. If he won't file for the divorce, her only option is then annullment.

What is the advatage of granting a foreigh divorce..Is it faster? Or cheeper or easyer to get then annullment? would he file in philippies? Does Philippies reconise divorce from foreighners?

A divorce filed by a cooperative foreign spouse is generally faster, easier and less expensive. You will need a certified copy of the divorce decree and there is a legal process required in the Philippines to have your NSO record annotated. There have been a couple of posts here in the past from people that had the divorce annotated, but I don't remember who they were. Once you have the divorce decree, I'm sure any family law attorney in the Philippines could help you get it done fairly quickly and with much less expense than an annullment.

I agree with jean and marlene, yes, if the foreign spouse filed for divorce and granted, your fiancee' can get the divorce decree and bring it to NSO to annotate her MC. That if she can get in touch with her ex-husband...

If there's no way to contact her ex-husband, she really needs to file an annulment...

Another Option:

He can go to Philippines, change religion to Muslim and have as many wives as he is able to support
