First let me just say that I have a deep respect for anyone who has completed all these forms...

OK, here is some history before I ask some questions.

I moved to Thailand to work and met my wife over there, we have been married for 1.5 years and now are working on getting her status adjusted. Since I have been earning Thai Baht for the last 2-3 years and just recently got a job at a electronics store as I go back to school, I am below the poverty line.

My father will be sponsoring my wife as well.

So we both fill out an I-864, this much I know. but should we file as joint, or both put sponsor?

Further more, since I just started work, for annual income, should I speculate, or simply state that I have just recently started my job.

Should I just write in 2 people for letter g so that our household totals are equal, despite the fact that my mother has no income to combine?

Yes, put your father down as a joint sponsor. Check part 1, d - "i'm the only joint sponsor" when your father fills out the I-864. Your mother would be counted as a dependent, so would you, and your wife - on your father's form.

For your new job, did they provide you with an offer letter stating the 1st year annual salary? If not, you should stay conservative with the estimate, in case you get challenged at a later date. Typically you will need to submit the employment verification letter showing income/wage.

I can get the letter from work, but the thing is that I will be working commission (not 100%) . I worked for them before while in school and I was earning about $11 an hour. I used this to do as you say, make a conservative speculation.

Gah, I graduate, move to Thailand and make great money for the country and now I move back to get a second undergrad degree because I don't want to do anything related with my first degree. So here I am stuck filing all these forms, oh well. it will all be worth it once I am done with everything...

I can't answer your I-864 questions, other than to suggest writing a notarized letter summarizing your situation. In that you can state your employment situation, speculated earnings and make your case as to why your wife won't become a public charge. If you didn't file taxes the letter is requirement, where as otherwise it is optional.

The real reason I am writing is that a lot of people are going to be interested to know what it was your wife did to convince the consular officer to grant her a tourist visa. Many have tried and failed.

I can't answer your I-864 questions, other than to suggest writing a notarized letter summarizing your situation. In that you can state your employment situation, speculated earnings and make your case as to why your wife won't become a public charge. A notary simply acknowledges that it was you that signed the letter & has ZERO to do with the content so will have no bearing on the facts.

If you are actually doing an AOS you will be required to submit your tax returns even if you did not pay taxes in the USA. showing income from Thailand . My own experiance with this type of situation was years ago & the laws may have changed but its easy to check & easy to correct if you need to.

You will also be required to submit a letter from your US employer with start date, present income, & length of employment forecast. In addition they will want 6 months of pay stubs. I would keep in mind that by the time you are required to submit this info you will have been working at your new job & probably long enough to qualify anyway.

Speculating about income just wont work.

Your 864 will have to be correctly done & as you have indicated you will need your co sponsor. If you dont do the 864 according to the instructions you will recieve RFEs & each one will take about 2 months to resolve. In the instructions you will see how to have the sponsor fill out his own documents which are seperate from yours.
