i were in US at 08/30. at port of entry , i did not get I 94. Now applying for AOS. do i have to fill out form i102 together with i485 as many people said?Or i just said that not issue at POE?

also i and my husband got married at 12/09. and now i am collecting document for AOS. therefore , i haven't submit AOS yet. So is it will be trouble for me because 30/09 is the last day for me in status.

I did not issue I 94, so when i submit AOS do USCIS know that my marriage which is 12/09 is with in 30 days for k1 visa.

Also, i translate my bithcertificate by my self is it ok and do i have to notorize my signature.

Thanks in advance

Check closely in your passport, POE staples the I-94 in the passport.

If not then file I-102 to get a replacement, or if POE is nearby try visiting POE and explain that I-94 was not issued.

I-94 is a card handed out to every NON-Immigrant on air flights to fill out and have handy when going through POE.

Thank for replying. I am sure that i did not get that. so when i submit AOS do they know that my married day which in 12/09 is still in 90 days of entry.

and i haven't submit it yet, so i will be trouble with that. because yesterday is end of 30 day.

If you were not issued a Form I-94 at admission to the U.S., or are filing this application with an application for extension of stay or change of status, file this application where you are filing the accompanying extension of stay or change of status application.

You file the I-102 with your I-485 when adjusting status, just marry within the 90 days.

There is a $320 fee for I-102. :( I would be looking hard for the form.

If you dont have I-94 then you will need to attach an I-102 and fee to your I-485 petition, it is the same as if you were to have lost the I-94 card.

It is recomended to have a third party do the translation.

USCIS:

Address

USCIS no longer routinely requires submission of original documents or "certified copies." Instead, ordinary legible photocopies of such documents (including naturalization certificates and alien registration cards) will be acceptable for initial filing and approval of petitions and applications.
