Was married on the spur of the moment here not abroad as planned while my girlfriend was on a 6 month tourist visa for a long visit and we are filing our AOS paper work now. Question do we still need to include an I-130 in our AOS/I-485 packet now that she is here in the U.S.A. ? And if so it can go all together right? She has no Alien registration # can we put none on the forms for that question & A # ?

About the G-325a biographic form I understand two copies need to be sent in one for her the applicant and one for me (as petitioner I guess?)..? I just put my info in and leave the rest identical to hers..? Is that correct? The instructions for it are vague and say nothing of sending in two copies just hear that on the forums.

Much thanks for any clarity on these question

Another follow up question, on the I-485 form

Part 2. Application Type. (Check one)., I am applying for an adjustment to permanent resident status because: The choice I should choose I am not sure of…? There is nothing for married on a tourist visa while in the U.S.A.! Only thing close is a box labeled Other basis of eligibility. Explain. Can that be marked and accompanied by a brief explanation such as married to a U.S. Citizen currently applying for an adjustment of status…?

Yes you must still file a I-130 petition.

Yes the I-130 is filed together with your I-485

Yes you put NONE for the A#

You fill out the G-325a for you and then fill out a G-325a for her. Since you are filing both an I-130 and an I-485 you will have 2 sets of 4 pages for her and 1 set for you. I am not sure if it necessary to include both the G-325a in both your I-130 and I-485 packets. When we filed we had two sets of paperwork. 1st set was the I-485 packet and the 2nd set was the I-130 packet. We submitted a G-325a for my wife (UKC) in both the I-130 and the I-485 packets. I (USC) submitted a G-325a for the I-130 packet.

I replied to the other thread you started regarding your PART II of the I-485 form.
