Hello,

I am currently involved in preparing a K-1 petition for my fiancee in the Philippines. I had a relationship with a Filipina before and I filed a K-1 petition for her last year that was approved. However, just before it was approved the relationship I had with her disintegrated because our religious differences suddenly came to the forefront at her instigation, and also because I discovered she was having a secret affair with another American. I did everything I could to save our relationship, but she just wouldn't have it and refused to answer my phone calls or respond to my e-mails.

Afterward, I tried several times to kill my petition for her, but being unfamiliar with correct K-1 withdrawal procedure I unfortunately bungled my attempts by not providing all of the required information in my requests. Eventually, after about 4 months of back-and-forth correspondence and lost time, I did mail the Manila embassy a proper request which was honored. I received news from them that on July 7 they sent my petition back to the NVC and then to the USCIS service center to revoke its approval.

My question is this: Is it okay if I go ahead and mail my petition (with waiver request and supporting documentation, of course) for my new fiancee to the USCIS while my old petition is in the process of being canceled or should I wait until I receive the official notification that the old one has been canceled and withdrawn? It seems to me that the proper thing to do would be to wait the extra weeks until I receive the notification, but naturally I don't want to wait if I don't have to.

I waited until I got a I-797 saying my petition was cancelled. Took about 7 months. Sent the NOA in with the new petition a year later. I don't think it was necessary to do so tho. As long as it's on record I imagine you can file a new one.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship
