I filed for my husband's AOS in April '08. We reside in Dallas, TX. I do not have any income currently so we used my husband's income on form I-864 who is a Phd. student at present. We also filled out form I-864A to use my father's income who resides in Buffalo, NY. Last week we received RFE (two pink sheets) saying that I need to show evidence that my father is a household member. The other pink sheet says that my husband's income doesn't meet the federal poverty level. As far as I have understood the whole thing, I think I need to have my father fill out an I-864 as a joint sponsor. I'm very confused. Could someone please guide me in the right direction as to which form to fill out and how to go about this? Also, should I write them a cover letter with an explanation? Please, help.

hi your father should fill out 1-864 not the 1-864a because you don't live the same address..

and did u filled out 1-864 also? but put 0 as your income? and you just added your husband's income?

Yes, I did fill out I-864 and showed my income as 0 and added my husband's income. Should I also write a cover letter explaning that I had sent in a wrong form (I-864A) and should have sent I-864 instead? Thanks for your help.

yah cover letter will help, .. and your father should fill out again --this time the 1-864, photocopy his driver's license, state id as a proof of his address in USA,,, or passport, (just additional though, doesn't hurt if plenty evidence :)

One more question..My father will have to check "I am the only joint sponsor" box in the part 1 of form I-864, right??
