Hi,

My husband came to the US in a J1 visa not subject to 212(Two Years Home Requirement). His visa expired late march. Right now he's here on his 30 days grace period. We got married a couple of weeks ago(after his visa expired) and we have our AOS package almost ready. But I'm worried about his current USCIS status and filling the I-485 on the right way. I hope someone can help us with some doubts we have:

  • Since he's here on his grace period what would be his "Current USCIS Status"?
  • The fact that we got married before the end of the his grace period means anything?
  • If we ended up unable to gather all the information necessary to file the AOS package before the end of his grace period, will that make a big difference in our case?

Any advice would be really helpful. Thank you all.
