I graduated in December 2007 and i applied and got approved for OPT but i have returned to my home country and my student visa has expired. I was waiting for my EAD card from USCIS so that i can go renew my visa at the embassy but it was lost in the mail and they say i have to reapply. My boyfriend and i got engaged this year and decided to apply for the Fiance visa instead. We thought that would be best since i have to be out of the country while the application is being processed anyway and also because if i reapply for the OPT card and we get married in the US anyway, i'd have to come back to my country for the processing to take place and we dont want to be apart again. Our concern is that, since i was approved for OPT and although i'm not in the USA to use it( although i think it is still in the USCIS system as being valid)...will that affect the approval for my fiance visa?. Is there anyway i can prove to them that i havent been in the country and didnt have the need for the OPT? Acccording to some, OPT cannot be canceled. What can i do???!!!
