Hello friends,

It's been a month since my fiance (K1 visa) came to the state. We went to County Clerk office yesterday and got married after waiting two days of issuing Certificate of Marriage. So we are legally married now.

I am ready to file I-485 form. I know that I have many things to prepare to complete the form. Working on the main form I-485, there were question

-----------------------------------------------------

1. Current USCIS Status

2. Expires on (mm/dd/yyyy)

-----------------------------------------------------

I saw my fiance passport yesterday and found that there was a DHS stamp that saying

"K1 until 2/28/2008"

She came in on 1/28/2008. The officer give one month for K1 status(?).

Some in this forum says that K1 status is gone once coming into the status and I-94 status kicks in for 3 months.

I don't worry about the day because we got married within 3 months of arriaval via K1 visa.

My question is how do I answer for the questions????

Also is it possible to apply SSN without work permit? I read the SSA website and they said that work permit is generally required to get SSN.

1- K-1 visa holder, expires on date listed on the I-94 card.

Look at the I-94 card, that should show 90 days validity.

There is no place saying that 90 days. There is a DHS stamp "Status K1 until 2/28/2008"

Should I say 2/28/2008 as the stamp? or just add 3 months to the date of the entry (1/28/2008).

I would visit your nearest CBP office and see if they can correct that notation. It may complicate things if you run into an ####### adjudicator at USCIS, you have to provide a photo copy of the I-94, and if they see marriage date after the date on the I-94, they could say you did not marry withing the validity of the I-94 card.

I called the CBP office and was told that the date on I-94 card on my fiance's passport is incorrect. They said that they should give 90 days instead of 30 days because of K1 Visa holder. I called local office and was told that I can stop the office by person to correct the problem. I have to burn my leave again, ahhh....
