Hello All,

Today I registered with VJ. I have been reviewing this site for about 2 months and have learned so much. THANKS. What I am becoming confused about deals with the different visas. I would like to understand the differences between K3, CR1/IR1, and DCF.

Here is a little information about us.

We married in Jamaica 9/2006. I am a USC and he is Jamaican. We have filed the I-130 back in 7/2007 and recently received the NOA2 on 12/14/2007. I am now waiting on the NVC to notify us of receiving the information from USCIS. Our attorney advised us to file for Consular Processing. Is that the same as DCF?

I would like to know what happens next.

Please advise. :unsure:

It does not sound like this lawyer knows what they are doing. If you are living in the US, you cannot even file for DCF (yes, this is what he meant by filing for Consular Processing). And if you have been living in Jamaica for six months or more, filing DCF now would mean having to cancel the original petition and start all over again. Although the DCF process is much quicker than going through a US service center and NVC, at this point, it would end up taking you just as long as completing the current process.

Your husband's interview should be before Sept of this year (I can't imagine why it wouldn't be within the next five months or so but I am not completely familiar with timelines for Jamaica), and since you will have been married for less than two years at that point, he would receive a CR1 visa.

The next step from now is the NVC process, which is fairly complicated, but there's a good guide and lots of help here. Then it will move on to the embassy in Jamaica and then there will be an interview for your husband. Once approved, the visa itself comes quickly. The visa becomes a two-year green card upon his entry to the US.

US Immigration Timeline

24 Feb 2007 - Sent I-130 to London USCIS office (I'm the petitioner)

25 May 2007 - NOA2

2 June 2007 - Received Packet 3

12 Oct 2007 - Sent Packet 3 back by special delivery

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)

*Note: Any delays in our case are only due to us taking things slowly
