Court Order Name Change - Green Card and Passport Query

Hi folks.

I have a slightly unusual question about travel with different names on GC/Passport.

I got AOS through K visa and some time after my wife and I got married we decided to both change our surname.

When we married we opted not to change names until we could figure out how best to do this. Eventually (after some snafus with the DMV) my wife and I went to the District Court to get a court order to change our names. We got the name changed with Social Security and with the DMV.

I plan on travelling next year to Ireland to visit relatives. My passport is in my old name and not due to expire until 2021 - and I plan to apply for citizenship in 2018 once I meet the residency requirements.

I am planning on changing the name on my Green Card and wondering if I have to change it on my passport also or if it can wait a bit. From what I can find out, Irish passport requirements include 2 pieces of evidence of minimum 2 year usage of new name.

My understanding is that:

  • you travel and book flights using the old passport name when going abroad;
  • if there is a different name (new last name) on the green card, when you get back to the U.S. you present the green card, passport, plus an official document explaining the name change. (in my case, certified copy of original court order).

Am I correct in this? Or am I totally wrong?

Reassurance and advice would be welcome.

My wife and I had a similar situation. Her GC and drivers license are with her new name, but her passport is her old name. We haven't had any issues at all traveling, both together and her solo. She has re-entered the US 3 times with this situation. Twice through the airport in Houston, TX and once on a land border crossing in Brownsville, TX. She carries her GC, passport and a copy of our marriage certificate with her...although she has never been asked for the additional documentation.
