On soon to be expired OPT (non STEM)

Came to US on F1 visa, graduated from my program may 2013 and received OPT in July which expires June 30th 2014.

Application for AOS along with petition from my USC husband and I-765 received by USCIS April 11th.

Biometrics done May 14th.

Received appointment notice for I-485 interview to take place July 24th.

According to current processing timeframes for I-765, it's not looking like I will receive new EAD before my current one expires on the 30th.

My boss wants to know if it is possible for me to continue working for the company as an unpaid volunteer after my EAD has expired, until I received new EAD after which I will be back on payroll.

Is this allowable? Will this have any impact on my pending I-485 application? I have to wait until my lawyer is back in her office tomorrow to ask her advice but I'm hoping someone sees this sooner than that!

It's absolutely impossible for you to "volunteer" for your company. This is expressly forbidden.

As the universe would have it, I just received notification that my new EAD was picked up by the USPS for delivery today, tracking number was provided and I should have it in hand within 7 days! Whew! Talk about cutting it close. I advise anyone in a similar situation as I am to apply for AOS as soon as possible even if you have to borrow the filing fee from a few friends/family!
