  1. I had my visa interview on the 30th of January 2013. I could not book my medical till the following day. So i went for the interview bringing all the required documents, however i was told i need a new NSW police check (as mine had expired) and a copy of my partners W2, which i was confused about as we had a co-sponnser... Anyway I emailed the W2 today and according to my australia post the medical should be there. My question is will the consulate acknowledge the medical report and W2 as meeting the requirements? and if there were any problems with the W2 or medical would they respond immediately or wait till they received my police certificate, which is going to take another 2-4 weeks. I am anxious to get this over and done with and am not happy to have to go through the police certificate process again! I obviously don't want to book a ticket till i HAVE my visa! which i thought i wold by now!

    any help appreciated!

  2. I also had to get a police check from Australian federal police while our of the country. I got my fingerprints done and sent them along with the completed from the australian money order and photo copied documents. Am yet to hear back, mail from Australia takes a while and police checks take 4-6 weeks so it's only been a week. Im guessing i should hear something back in 2 months (fingers crossed there are no problems!)

Well guys just a little update here getting our checklist together and i need to get my police certificate which will take about a month to process and then maybe 2 or so weeks for mailing so nothing much will probably happen in the next 2 months or so (pretty much a year since we petitioned) till we send off all required documents to NVC copy of passport birth cert, police check etc. by that stage should have a better idea of the visa bulletin too. fingers crossed

  4. Yeah, sorry I didn't update it till my partner got forms from lawyer juts to make sure of what forms they were and went in to do some paper work.

    Once NVC has collected the bills do they expire in a year? eg: if my priority date is not current within a year will I have to pay all these bills again?

  5. Hi guys,

    I have an update, paid IV and AOS today and now collecting required documents, certificates, police check etc.. which is going to be a nightmare as I am overseas and was not expecting this step for a while as my PD is not for a while! So, not sure how i'm going to get a fingerprint check from across the world... hmmmm..... Guess, it's good news that NVC are requesting all this though hopefully it means a jump in VB. hope it doesn't retrogress by the time i get all my papers organized lol!

  6. Thanks for the quick frank_kay. I will think about the lawyer thing. However, the news about my fiancee having to leave after the VW expires is very depressing. I assumed she could stay here during the process. We have already been apart for a few years.... Is there no way around this? I have coworkers who came under visas here and were able to bring their wife with them. We as LPR's cannot do the same? Basically then, until the priority date becomes active, she cannot stay here? How often would you come visit here? A few times a year, or is that looked down upon?

    Yes it is depressing! I came for 3 months in winter 1 month currently and hopefully back for Christmas. I think if you have an H1B you cna bring a spouse but they can't work i think...

    I have been reading for a while, and after having read thousands of comments in separate forums, I finally decided to ask a question here since people here seem very knowledgeable and extremely friendly. I have several questions regarding my situation, but one thing I hope I have misunderstood, is can my spouse be in the US with me while I apply for her LPR through the I130? I always assumed she could, but I have read some comments which make it seem like this is not the case.

    I am actually not married yet, but will be getting married abroad next month. I will return alone, but my soon-to-be-wife was going to come in the fall as a tourist, at which point I planned on filing her I130 and assumed she could stay here while the (long) process chugs along. Is this correct? Or will she have to leave before her 3 month visa is up and therefore can only come in 3 month intervals?

    Anyway, thanks a lot in advance for your help.

    PS Things are so confusing that I was thinking of doing things through a lawyer, even though the costs are astronomical. In people's experience, is this helpful/necessary?

    I have gone through a lawyer and I think that the cost is not worth it, it's relatively simple and with the wealth of knowledge here I don't think it's necessary, and a lawyer can't "speed it up" they just assist, you still have to fill out the forms- that being said I like the piece of mind that comes from having a lawyers assistance. (i found these forums after hiring a lawyer)

    In regard to your fiance (I'm assuming) She will have to leave after the VW expires (unless she gets a H1B or some other type of dual intent visa) defiantly do not overstay as this will cause a range of problems.

    I have visited twice now and the first time I stayed for just under 3 months and the second time 2 weeks (however i got puled into secondary questioning the second time- i think this was due to my long stay) so i'm hoping they let me in for Christmas!

    I entered on the VWP and last time I was in the states was just under 3 months departing in march 2011 so that could be a possible reason.

    The first guy asked me heaps of questions like why didn't I stay longer in the U.S the first time, (I said cause you can't on visa waiver) what I did for work and if I had any business cards on me (i said no) he did not ask if I had family in the US then sent me to secondary.

    The second guy asked if I had relatives in the U.S and I told him my husband who is a LPR, he asked if he had filed for me and I told him yes. then a bunch of other questions and i showed my ticket to Canada (as I am going there on the working holiday program) then he gave me back my passport and let me in, which was a relief! the next time I return will not be till December for the holidays as my husband will just visit me in Canada. SO fingers crossed that I'm ok!

    I arrived in the US a few days ago and was questioned for a while at customs then my passport was taken and i was sent to "secondary questioning" which was very scary! I was let in after answering the questions honestly and showing some paper work.

    Has anyone else had any experience with secondary questioning and will the fact I was sent to secondary questioning make it harder for me to visit again (eg: is it on my record that i was sent there?)

    A while ago I asked about the option of going to Canada and getting a working holiday visa, the good news is this has been approved and I'm moving there in late June! (if only USCIS worked as quickly!!) I am spouse of LPR so it's looking like a bit of a wait and Canada is a hell of a lot closer than Australia!

    My questions is will I have problems traveling into USA? I'm entering USA staying for 2 weeks then going to Canada. I know that my Husband will have no problems visiting me, but my sister and I planned a road-trip in December and my whole family is coming to visit us for Christmas and I want to be able to enter- I don't want to throw Christmas presents over Niagara falls! SO how can I prove I have ties to Canada if the whole nature of my stay is temporary? (1 year to 24 months)

    Thanks for any Help and hope the visa bulletin moves quickly so I don't have to worry about "visits!"
