We had the interview today, after a few issues with my previous visas (I had many : J1, F1, H1B) they finally found my J1 waiver in the system so we got at the interview and the guy told us ( me and my fiance ) that we are approved. He said to wait about an hour to get the visa, so we did , but after an hour he said the security check for me wasn't received yet so that will take a while but there is no "nothing to worry about" and we should come back tomorrow. I DO NOT believe this "no worries" thing because about a year ago I came home with my fiance to meet my family , having H1B at that time. They told me the same thing: "You are approved and come back tomorrow" and next day they told me the visa is not ready yet and it will take more time. After few months they called me and told me that my H1B visa is "not denied" but is in "administrative processing" and we never heard anything ever since. At today's interview the guy obviously knew about my previous H1B interview and he said that wasn't my fault , it was something with my petitioner (my employer when I applied for the H1b).

    Will I be in the same situation again ? They didn't do my security check on these 8 months since I am getting crazy about this visa ?

    Any thoughts welcomed .....

  2. I actually wouldn't say this if asked...the K1 is not supposed to be a "get to know you" visa, it's a visa for those who are going to get married. I know what you are saying here, and I know that in reality a lot of people get the visa for this very purpose, but I would NOT say this to a CO. I think this could easily lead to denial because it comes across as you aren't sure if you want to get married.

    For us, this would have been simple (husband has very little family in Kenya, I am very close to my family here in the US and it would be impossible for some of them to travel to Kenya for a wedding) but for others they choose K1 for varying reasons. I think what Blob18 said is appropriate - that you don't want to start married life apart and would rather be separated from fiancee than wife. I think this question would be pretty rare though...I wouldn't worry about it too awful much.

    For what it's worth, lots of people on here (including me) went to our fiance(e)s interview and were granted the visa. I think the CO actually saw me being there as a major plus in our interview. Maybe check with other Romanian couples to see if fiances are allowed in, how it is viewed if they go to the interview w/beneficiary, etc?

    This is exactly my point ! At the moment I am waiting for 2 couples who have interviews these days both WITH the fiance , will see ...

    And the TRUTH is actually the best answer : I am planning to get married there because my fiance has whole family there and I have here just my mom ( to not count all our friends). Honestly I lost most of the contacts with my home country.

  3. Simple simple answer.... we waited to wiat to get to know each other better. We want to see how we are together when living in his country versus us living in two separate places apart. we love each other, but we want to be sure before getting married we are make the right choice together. the simplest answer is, Both my finace and I want to make sure I can take leaving my country to go live with my fiance in the new country. Or will I miss my friends, family, and others too much wishing to return. The K1 is the get to know you phase. It allows both of you to see each other and date in the pther person's country while determining the relationship. Sometimes things are not always as they seem after going to live with a person. the question should be why get married? Makes no sense until you have seen both places and you have yet to see your finace's place or relatives....

    Thank you for the response but this doesn't apply to us because :

    I've been in US for 5 years prior to this and we lived together already 2 years . Anw it should be our choice for how long we should have date and the idea is he proposed NOW (well 9 months ago) so we are engaged NOW.

  4. Got NOA2 after a long hell and I finally got an interview date. Our previous lawyer (who we fired bcz he did nothing and delayed our petition 1 month) told us that would be safer if my fiance will come at the interview. Today , 2 weeks before the interview our current lawyer warned us that if my fiance will show up with me at the interview we might get denied because they will come up with the idea: "Why u don't get married here and process an immigrant visa ?".

    I AM VERY CONFUSED NOW ....?!

    If this is the case than why is the K1 for ? Everybody should go to the fiance(e)'s home country and get married , right ?

    If this will happen than we have to wait another year apart ? Indeed, my fiance visited me 6 times in 10 months because he cannot live without me and he spent a lot to see me and YES he has money for ME otherwise he wouldn't be able to "support" me as they request it .

    There are some contradictions here:

    • if he CAN come (financially) to met me than why we don't get married here . ?????
    • if he wouldn't visited me they will deny us because we have no proofs of ongoing relationship ?????

    Still v confused ..... help !

  7. I don't want to disappoint u, I totally recommend to do it but:

    We first contacted congressman office when we reached 5 months mark. They inquired for us and they were told that we were within the average processing time so call in 30 days. When we reached 6 months we contacted again the congress office (btw they are nice people and apparently want to help) . They get back to us and said they placed a service request and we will here within a week. The week passed and we contacted again te congress office (sounds familiar now , right ?) and they get back to us again and they said we will here latest at the end of the week. Now this id "the week" , as u may see we are here ... 6 1/2 months ....

  9. We have almost same timeline and also similar story and yes is a huge stress the whole thing ! To not forget the main reason USCIS ignores K1s timelines is bcz maybe you will break apart and US won't need to accommodate u! As u know this is the test. Me and my fiance are for the first time BOTH depressed and hopeless. The past year we managed to get depressed on turns so the other one could support . Even if we are both down we are still decided : if nothing works he will move to Europe. He is loosing everything, an excellent career, family, friends and me also my career, friends, etc (I used to live in US 5 ys) but we know we waited a lifetime to meet each other.. The problem is we need an answer : yes or no and we've been waiting too long .

    So I don't think I can advise u I just suggest to analyze if u truly think he is "the one". If u feel he doesn't fight for u move on. If u think he is with u USCIS cannot stop u guys !

  10. I had to read this post because I cannot handle the situation well anymore. I decided to not check VJ so much bcz it drives me crazy seeing approvals over our date (I am not upset on the people getting approved, though - actually I am happy for them) . I really need a confirmation this will EVER end.

    BTW: We contacted our lawyer and congressman and placed a service request and still ... nothing .

    So please tell me, if u can, this will END !!!

  11. in all honesty i don't think any of us "foreigners" should be doing anything to come against USCIS. We are trying to get in to a country and Its not going to do us any good by posting/tweeting negative things about the process or about how retardedly slow they are. Yes, we are all under stress but unless its the American petitioner directly that is making a "voice" and tweeting, i don't think its healthy for us foreigners to be coming against the government and there process like this.

    If the government wants to find stuff out about the people who are trying to get in to America they will most definitely do whatever background work they can. That means your Tweets, your facebook, and your Visa Journey posts may not be helping you but hurting you. Yes, i do agree that if we've hit the 5 month mark then we should call and try to get it going but we also need to remember that we need to be nice to USCIS because they are the ones who can deny us from being with our loved ones. So don't make them mad if you are not the petitioner!

    As I said before : we want to politely ask USCIS to care about us ! I saw some ugly tweets ... those I don't think will help. Still tweeting is not a bad thing , we don't hurt anybody. We ask an institution (USCIS) to Approve, Deny or send us an RFE and by us i meant the immigrant AND the USC petitioner who is hurting too because of the delays.
