  1. ah, well that was easy: right on the instruction page, under "special instructions". Seems that i can reapply for he advance parole as well for no fee?

    "If you filed a Form I-485, Application to Register Permanent Residence or Adjust Status, on July 30, 2007, or after, and you paid the I-485 application fee required, then no fee is required to file a request for employment authorization on Form I-765. You may file the I-765 together with your I-485, or you may submit the I-765 at a later date. If you file Form I-765 separately, you must also submit a copy of your Form I-797C, Notice of Action, receipt as evidence of the filing of a Form I-485."

  2. I sent in my husband's EAD application (765) along with the advance parole and the AOS, and on one form, (the I765) I put a typo - said he was born in 2011, when clearly he was not. (I originally thought this was USCISs error - it was not). I sent them 5 proof of date of birth documents, along with the original i485 application with the correct date, but they sent everything back saying the typo is my fault, and because of that, i have to reapply and pay another $380... Can this really be? I'm getting penalized $380 because I made one typo on the 25 odd pages of repetitive forms they make you fill out?

    Now, the green card is still in process; the DOB on that one was correct. DO I just wait for the Green Card, and hope it comes before he really needs the EAD? Will it get held up until I take care of the EAD issue? Also, this process started in September, and still my GC is in "initial review" - does that sound right?

    HATE THIS.

  3. GOOD GOD Do you guys think anyone from USCIS has actually read any of these letters?! Are they written by robots? They are totally ambiguous. "This is a letter to tell you about a letter we may or may not have sent you about the interview you may or may not need to have on February 14th... BUT, maybe we mailed you your green card or another document which may or may not have been approved!! This perhaps corresponds with a status report on our website that we don't really know anything about, although you might want to look at it, because the information on the site may or not be correct and will tell you what to do. or not do. Welcome to America!"

  4. I 94 that's what I meant...

    Update: I've just received an email from USCIS saying that I have to mail the card back to them, writing a letter that explains in detail the error, and provide all kinds of supporting documentation THAT THEY ALREADY HAVE ON FILE... THEN they will decide whose fault it was, and if its determined to be their fault, they will issue a new one.

    I also can't file my taxes until he gets a SSN and I want my $$$!!!

    GARRRRHHHHRRRHHH!!!!!

  5. So, after several months of waiting, due to a bank screwup and a sickness, our I485 case FINALLY started to get moving. We received the Employment Authorization Card in the mail last week and were excited to finally get him a SSN and a NY State ID card, and a Bank account and finally make him, like a real person.

    Except, USCIS made a typo. They put his DOB as 3/25/2011. As I did not marry an infant, this is clearly a typo, the fault of USCIS. Today was the day I took off work to go to the Social Security Card Center with my husband. I should have called Social Security to find out if the typo would pose a problem, but I thought "we have two other forms of ID that have his correct B-day on, and it's obvious that it's a typo..." so went anyway, and alas, after waiting in line for 2 hours, found that Social Security can not issue my husband a SSN until we have a correct card.

    (Sidebar: We also went to the SS office in July, when we had 26 days left on his I90 and she said we couldn't get one because we needed 30 days, which turns out not to be true, of course. - It's 15 days, for anyone who doesn't know - which compounds my extreme frustration)

    OK, fine. I should have called SS first. My bad. So I called USCIS right there, and they put a note in the record to change it and expedite it, and it should take 3 weeks, apparently. Then I said "and can you also just put a note in our I485 case, so that the same thing doesn't happen to our Green Card?" No. The answer is no. She can not put a note in a pending case. She can not access the case to make sure they have the right DOB. NO.

    Instead, I have to go to a website and MAKE AN APPOINTMENT which may or may not take 2 weeks, to go downtown to see an "authorized immigration officer" to MAKE SURE USCIS HAS NOT MADE A TYPO. How is this fair, reasonable, effective, or logical? HOW!?!

    (We then went to the bank to try to open him an account. I figured it would be fruitless, but it was right across the street, so we went and asked anyway. And yes, he needs either a SS Number, a bill with his current address on (which he would not have because he doesn't have a bank account, so why would he have a bill coming to his house? OR a letter from the SS office saying that they've approved his application and will be sending him a card with the SSN on it.)

    It's no wonder this whole thing costs so much when they not only have to pay people to incorrectly issue all this ####, but they also have to pay people to answer the phones who are only authorized to "put notes in pending cases", people to design and maintain websites where you make appointments to go see other people who can open a computer file to MAKE SURE THEY DIDN'T SCREW IT UP.

    obviously - blowing off steam here. So far, i have no SS#, no bank account, no NYS ID, and one employment card which is apparently invalid. All because someone wasn't paying attention.

    Anyway, the lessons learned:

    1) If you receive your Employment card and it's wrong, request a new one right away. To do that, you call USCIS and they will expedite a new one at "their costs" because it's their error.

    2) If you suspect that the same incorrect info might appear on your green card (she wasn't able to tell me if the info was linked), you can either make an appointment on the infopass website to go talk to someone to make sure it's correct, OR you can wait till it arrives and request a new one (see #1)

    3) If you have just entered the country, you may apply for a SSN granted you still have at least 15 days on your I90, NOT 30.

    4) You can't get a bank account (at least not at Chase) without EITHER a SSN or a bill (phone, utility) with your present address

    those are things i learned today.

  6. Is an EAD Card the actual green card? I also had received an NOA for receipt of the I-765 in conjunction with my wife's K-1 but the only thing I received after was her green card, with a note that included that it was authorized to work

    I have this vague memory of someone telling me that the EAD card was a sort of "tide me over" so the person could be authroized to work while they're processing the green card, should that be held up for any reason - RFE, or Interviews, etc. Maybe if you get the GC, you don't actually need at EAD?

  7. OK, porn aside - whether or not everyone does it, etc... May I ask how you met? In trying to understand this guy, It would help to know if you met, say, at work, or if you met, say, on a website that specializes in helping older American men meet young Asian women ... for example.

    No judging, whatever the case, but if that IS (theoretically, of course) in fact how it happened, one can't be terribly surprised at this particular... "interest" of his?

    None of it excuses his holding his "position" in the relationship over your head, though. As the sponsor in my marriage, I can admit it is sometimes hard to juggle the "I'm doing this becuase I truly love you" with the "I am giving you everything!!!". It's a huge adjustment at first - going from total independence to basically having a dependent, and it's easy to accidentally say things that come across like you *think* you own the other person. I never once thought that my husband "owed" me anything, but I know I've said things out of frustration (and fear of financial ruin) that would give that impression! You'd think, though, after 5 years, you'd have reached some sort of mutual understanding that it's a marriage, not an "arrangement".

    Assuming this "incest" thing is like, "twins gone wild" and not "I'd like to marry my 12 year old neice", I'd say focus less on the porn itself, and more on the manipulation and disrespect.

  8. In case anyone else encounters this:

    My husband got a Biometrics appt for 10/18 but fell ill the night before. We'd have gone anyway, but it was a rather... violent ... stomach flu, he was miserable, and I couldn't bring myself to shove him in the car.

    Anyway, I called USCIS and they said I had to write a letter directly to that particular office (Brooklyn) explaining why we missed the appointment, and request a new date. I mailed the letter and received another Biometrics notification about 2 weeks later. The new date was 12/5.

    So, it was easy and straightforward, but it set us back about 6 weeks.

  9. Hi Everyone,

    I'm about to file the change of status information for my husband (!), who entered on a K-1 Visa. It's a huge amount of money, some of the USCIS forms don't work, so I've had to piece this all together, and i wondered if any of you who have done this can just read this and let me know if I'm missing somethign or on the right track!

    He entered on 5/6/11 and we weren't married until July 25. The I-94 expired on Aug 3, and he's been "out of status" since then.

    So. I've filled out the I485, and have all the necessary go-withs.

    I've filled out the G325A form (Just for him... I don't need to do me, this time, right?)

    I've filled out the I864 Avidavit

    I've filled out a I765 Employment thing.

    I have photos and the fee, which I believe is just the $980 plus the $85 Biometrics. (i read that if you file your employment form with the 485 that you don't have to pay the additional fee)

    I understand that:

    - They'll eventually call or email or email to set up his appointment to go in and get fingerprinted (the biometrics)

    - I can, any time after receiving the NOA, apply for advance parole. (see below)

    - Then, they'll someday call for an interview, at which we both must be present with lots of love letters and toothbrush anecdotes, yes?

    Questions:

    - To apply for Advance Parole, I have to have specific plans, right? I can't just apply for it in case we decide to go somewhere?

    - Here's the tricky bit. We waited too long to get him a social security number. I went to the office in July and they said the I94 had to be valid a further 30 days. This forum has said 15 days in places, and the SSA website said nothing. So, at what point will we be able to apply for this again? Must he actually have the green card?

    I think that's all. Looking forward to getting this step done with!

  10. As long as he has more than 14 days left on his I-94 he's eligible for a SSN so go to the SSA to get him that.

    Soon as he gets the SSN then he can get his licence, find out if there's a deadline on that because some states won't let you get one if your I-94 is expired... so check that out.

    Once you're married apply for AOS (there's a guide in my signature). Easy peasy :) Just requires some work and planning. You'll do fine :)

    FYI - the limit is now 30 days. your I94 has to be good 30 days past the application date. We waited too long and couldn't get it, and now we have to wait until his visa is reissued (change of status to whatever's after the K1 visa) before we can apply for it. don't delay! go the minute you arrive!

If secondary evidence also does not exist or cannot be obtained, the applicant or petitioner must demonstrate the unavailability of both the required document and relevant secondary evidence, and submit two or more affidavits, sworn to or affirmed by persons who are not parties to the petition who have direct personal knowledge of the event and circumstances. Secondary evidence must overcome the unavailability of primary evidence, and affidavits must overcome the unavailability of both primary and secondary evidence."

    OK Opinion needed - He just showed me copies of two other documents that he DOES have: it's his police record and his "Certificate of Nationality"... Any idea if that would suffice as secondary evidence?

  12. You can also try calling the visa section in Dakar and ask them to send back the original. They are supposed to keep the copy and return the original.

    Advice to others...DO NOT Leave the interview area without verifying you have ALL the original documents you gave them!

    No kidding - The problem with calling Dakar is that you can only do it by buying a weird phone card at some hotel in Dakar and using that to call them. It's such a scam. I can try emailing them, though.

    OK its good to know we have a little time. The Visa in the passport expires in November, but the I 94 expires next week. We got married yesterday, and I'll hope to get some sort of birth certificate by November!

    SIGH. Always something...

  13. Hi VJ folks, thanks for your continued support throughout this overcomplicated process!

    My fiance entered the country in May, and the expiry date on his I94 is Aug 3. We will probably not get the marriage license in the mail in time to apply for change of status before the 3 AUG date, but I have read that as long as we're married before that date, it doesn't matter.

    We're marrying on Monday, and I will start the change of status paperwork on Tuesday. We have a problem with the birth certificate though. When he applied for the K1 in Dakar, he had a photocopy of the birth certificate, but the lady took it as well as the original. He's from Guinea, and the thing is hard to get a replacement of, and then there's the problem of mailing it, as they don't have a post office!!

    How essential do you think a birth certificate is? They have a copy of it (AND the original) on file, in Dakar, I guess(?) and he obviously needed it to get the original visa - I'm not sure what else we can do...

    any other dos and donts i should know, moving forward to the next step?

  14. My fiance has been in the states about six weeks - timing was terrible - he arrived just as I was traveling a ton for work. Anyway - I'm finally sitting down to try to figure out how to get him established as an actual person here, and I seem to be running circles. I want to get him a Non-driver ID card, but I need a SSN for him for that. But of course, to get him a SSN, he needs proof of citizenship. To open a bank account he needs both things...

    So, where do I start?

    We will marry in about a month - but for the moment, is there nothing I can do?

  15. Congrats to all those who got approved on the 1st!

    I am pretty patient, but in case my fiancée did want to contact the office to try to escalate our post-5-month case, who would we need to call?

    They're not going to do anything except read you a script until you're 30 days past your projected deadline, so I'd suggest just waiting until the 6 month mark and then calling USCIS daily.

    Seems like they're moving right along, but it's like the Ice Armageddon around these parts this week, so that might slow things down a little bit.

    GOOD LUCK! I got my NOA2 yesterday, about 25 days later than projected.
