Make sure your husband gets all the documents (sole custody) and permissions available from the Judge (court order). In the future, your step daughter will need a passport renewal and I know every country requirements are different, just make sure you don't have to deal with "both parents" signature/approval. I had to deal with something like this in the past and it wasn't easy!

My husband came on a K1 visa in August we are already married, have processed I-485 and are awaiting adjustment of status

My step-daughter (12 years old) is on a K2 visa but did not accompany my husband as her Birth Mother (who abandoned her at 2 years of age) refused to sign the documents for her to leave Brazil and travel to the U.S. Long story short we are in court awaiting the judge to give this travel permission for her to be able to leave the country. The judge set the trial date for December 22 and her visa expires December 19th.

Can someone please tell me what we can do to extend her visa? Or what our options are at this point?

Our daughter is living with my in-laws and we are all so miserable being apart ( I had been living in Brazil with my husband and her for the last 4 years and its just breaking our hearts).

Please help us with information you may have. They got their visa at the American embassy in Rio de Janeiro, Brasil

Thanks. As I wrote above someone told me who was turned away from the passport office for additional proof of mother/child biological relationship as the birth certificate wasn't issued within 30 days from the child birth. I only know she was a single mother. That's all I know.

So I am kind of anxious because it would be hard for me to get additional proves.

Hi guys! Do they require a child birth certificate that was issued within 30 days of child birth? if the child was registered 36 days later , do they reject such birth certificates at the passport office as an invalid proof of parent-child relationship? Just heard that from one VJ member and my eyes popped out of my head. Did anyone have to deal with it? I am talking about the situation when a child under 16 receives a US passport based on naturalization of one biological parent.

Where did you get that information about the birth certificate issued within 30 days of child birth? I am curious!

My son's certificate did not fall in that category, however, If I were you, I would apply with the certificate that you have, it is the only one, isn't it? Just make sure to have all the required documents on the passport application and you will be ok.

Yes, list the child. It is very important to disclose that information.

Even if the child is not coming to the U.S. now, the information needs to be provided. (Their relationship might change in the future, think of all the benefits for the child when your fiance becomes a U.S. Citizen)

I have some experience with K1 and K2. I had my son's biological father sign a notarized permit so I could travel with my son. At the time of the interview in Cd. Juarez, I was required to show that notarized letter.

I have a few questions: How old are the children? Does the child without the father around have a passport? There are a lot of cases when the father/mother is nowhere to be found and that is when things get complicated. Now that your fiance is still in Mexico, I'd suggest your fiance to get the full custody documentation and that involves seeing a Judge, etc. It'll probably take time, but believe me, that will save you a lot of headaches in the future!

Back in 2014, I did update my info at the SS office a week after I received my certificate and the same day I updated my DL (I changed my name) and a couple of days after, I applied for my US passport.

It is a good idea to update everything before sending your certificate. It worked for me!

I know it has been a while since we posted an update. The long wait was due to a letter received from the DOS requiring more information in regards with the full custody (I only have the physical custody). We received that letter the first week of June and since I don't have information from my ex husband (address, phone, etc/ he is not a US. Citizen and lives in Mexico) I wrote a very detailed letter explaining the situation (two pages). Yes, letter number 2 since I had already sent one with the initial passport application.

I have to mention that everytime I called the Passport Office or tracked online, no information or update was shown, not even when their letter was sent to me. I was hoping for the best, and finally the passport arrived today my son was so lucky to receive the mail and he could not wait to open the envelope!! We are so happy and relieved.

Now, time to go to the Social Security Office and update his status to U.S. Citizen.

My son and I were at the Post Office to apply for his passport. We were called 15 min. earlier than our appointment, no problem, we were there ontime.

Things did not start quite well, while this lady is assisting us and taking our information, she says: "this is not going to work", I asked why, she said: "where is his US birth certificate?... I don't need his green card... he is not a US citizen" Well, I was trying to explain the reason for all those documents (translations, etc), and she took my US certificate of naturalization, my son's birth certificate and his green card and talked to another post office worker (I have to mention that the office was really busy and crowded). She came back and told me she would take a photocopy of the green card only but she wasn't sure if that was necessary!! I also mentioned: "when I made an appointment, I was told I have to surrender my son's green card to the Department of the State, it is like an exchange for the US passport", she said I don't know anything about that. Since I have been reading posts here in VJ, I didn't want to compromise the process, so I decided to take all my documents and leave.

I was about to call again and make an appointment, this time with the Passport Agency, either L.A. or San Diego, but then, I decided to go to a different post office and get a second opinion. It was a busy office too but the passport window was empty, I had no hope to be assisted without an appointment but lucky me, the post office lady was helpful, I just wanted her to verify if I had the right information/documents to apply for my son's passport and told her what happened at the other office... she took a look and said: hey, you have all the documents, so she started taking my information and finalized the application process!

She also said "I'm sorry for what happened at the other office, the US Passport application for immigrating children of US naturalized parent(s) is common, but not all of the post office workers have the same training, and some of them know the rules, some have forgotten the proccess or haven't come across with a case like this before".

Well, now all we have to do is wait....

We are about to begin the US passport journey for my child under 16.

I am a naturalized US citizen, recently received my US passport and now we are applying for his passport. We have an appointment tomorrow 04/22/15

Reading a few posts about "passport for child under 16" I noticed some of them have been struggling to receive their minor's passport, so I am starting this post to share our experience with this process. My big concern is in regards to the 'absent parent' issue, I divorced his father on 2004 and I only have the 'physical' custody and he has to sign a consent. The last time we contacted him was in 2013 and now there is nowhere to be found.

These are the documents we will submit:

1. - Application for a US passport

2.- Child's Green card (original)

3.- Mother's certificate of naturalization (original)

4.- Child's Birth certificate (original) and certified translation in English

5.- Parent's marriage certificate (original) and certified translation in English

6.- Parent's divorce certificate (original) and certified translation in English

7.- Form DS-5525 Statement of Exigent/Special Family Circumstances, along with a notarized letter explaining in detail the request of the US passport without the non-applying parent's consent.

8.- 2 passport pictures.

9.- Check for the passport fee

We hope all these meet the requirements for the issuance of my son's passport!!

I would appreciate any comments and if you and your child went thru the same process, how long did it take to receive the actual passport?

Updating my Oath ceremony date!

I received the letter this morning and it was a huge surprise to find out it is scheduled for August 27.

Thank you Missicy and Mistere for your positive thoughts It seems that all the March applicants from Chatsworth, Oxnard and San Bernardino have received our Oath ceremony dates!

Just finished my interview and it was approved!

The office was busy today. I had to wait because my assigned USCIS Officer was interviewing 4 members of a family along with an interpreter, my turn was right after them!

My appointment was at 9:00, the interview started around 10:15 and by 10:30 I was out of the office

1. What is freedom of religion?

2. How many U.S. Senators are there?

3. When must all men register for the Selective Service?

4. When was the Constitution written?

5. What ocean is on the East Coast of the United States?

6. What is the capital of the United States?

What do we have to pay to the government? We pay taxes.

Everything went very smoothly and I got the N-652.

Thank you for sharing your experience Indeed, it will help some of us that will attend the interview in San Bernardino. (It is good to know about the free parking).

I had my interview on Friday the 18th at the San Bernardino, CA Field Office and wanted to share my experince hoping that maybe it will help someone.

I left my house with plenty of time to compensate for Friday traffic and unforeseen situations (didn't want to be late or in a hurry), even though the office is only 30 minutes away and I’m glad I did. I encountered traffic and Google navigation was close but not exact, weird because the map was correct. I arrived at the Field Office building 40 minutes before my appointment time. Looks like a fairly new building, plenty of free parking all around the building and the entrance is in the back of the building, they have a security check point with a metal detector (just like at the airport) and there were about 20 people waiting in the security line. The line moved a little slow and the metal detector was very sensitive, it beeped twice on me so I removed everything that had metal and emptied all my pockets into the bin that they x-ray. A lady had a metal fork in her purse which slowed things a bit, they did not let her dispose of it inside the building and was asked to take it back outside, so she did and had to wait in line again. After I made it through security they asked me what I was there for and I was directed to take the elevator to the 2nd floor. Right outside the elevator was a reception area with a tray on top of the counter, I told the lady I had an appointment and she asked me (with a very serious face and a short glance) to place the appointment letter in the tray, take a seat and wait to be called. There were approximately 30 people in the waiting area which had a sign with max occupancy of just over 160 (167 I believe), so it looked pretty empty. They had four or five entrance doors to the interviewing offices and also a restroom. There were signs saying that cell phone use was not allowed, but I guess they meant talking on it because a lot of people were using their cell phones (texting or ?), I left my in my car.

So I was about 20 minutes early and a little over dressed, most people dressed casual and some looked like they were on vacation on a tropical island, so much for appropriate attire. Some people in the waiting room looked very pensive, others nervous and some were doing last minute reviews on the civics questions. A few people were called in as I waited, a few tried unsuccessfuly to walk in with their companions, exept for lady that was legally blind, I was a little apprehensive of the unknown, but kept my cool and waited patiently when all of a sudden a male IO came out of one of the doors and called my name 5 minutes after my scheduled appointment and asked me to walk with him to his office (one of many), he stood behind his desk and asked me to remain standing, asked me to raise my right hand and was sworn in, he made eye contact without blinking, and I did the same.

He was very serious, to the point and business like, but very nice. He had a binder that was about a quarter of an inch thick including the 21 page N400 application on his desk, asked to see my green card and driver’s license (did not ask for the yellow letter that I received asking me to bring ID) compared them both against my N400 application and made some check marks with a red pen, then he proceeded to ask and verify every question on the application, asked if I wanted to change my name, asked about my wife, kids, job, address, aliases, etc... wrote some things down and made check marks. When he got to the cited/arrested part, I mentioned that I've had traffic fines (tickets) in the past, he asked what they were and if I paid for them, I told him yes and he just kept going. When he got to the yes/no questions, he made it a point to look at me straight in the eyes (maybe to see my reaction), he then reviewed every quickly one more time made some notes and took out a piece of paper that had three questions on it, he said he was going to test my english reading and writing skills, then proceeded to ask me to read the first question (Where is the White House?) he marked it correct, then gave me a piece of paper and asked me to write "The White House is in Washington, DC", he took it from me, looked at it and said thanks.

He then took out another piece of paper with 10 questions and asked:
What is the supreme law of the land?
Who vetoes bills?
What do we show loyalty to when we say the Pledge of Allegiance?
Who did the United States fight in World War II?
What is an amendment?
What is the capital of your state?

He then stamped, checked and stapled a bunch of things. Had me sign a couple of forms. Reviewed everything and gave me a form (N-652) that said: Naturalization Interview Results:
You passed the tests of English and US history and government
Congratulations! Your application has been recommended for approval. At this time it appears that you have established your eligibility for naturalization. If final approval is granted, you will be notified when and where to report for the Oath Ceremony.”
He then asked me if I had any questions, I said no, he said congratulations, have a good day.
I followed him to the exit and that was it. Not painfull at all.

Over all a good experience, better that I expected.

He did not ask to see, the yellow letter, tax transcripts, extra passport pictures, passport, selective service letter or any of the extra stuff I took with me just in case, only green card and driver's license.
Now I just have to wait patienly for an oath ceremony date.

Glad you got scheduled. Maybe we'll be at the same Oath Ceremony at the end of August. Seems like the number of applicants in San Berdoo have increased significantly which makes the waiting a little longer compared to October, November and December. Still average is 5 to 5.5 months which is not that bad... Good luck to you...

Sorry to hear about your experience with the Mexican Consulate, but believe me, I have been there before.

I have a couple of questions for you:

Where did you get your previous (expired) passport? If it was in Mexico, the Mexican Consulates in the USA usually handle a renewal very easily.

Why did you have to show your marriage and/or divorce certificate?

Years ago, I had to renew my passport (that I got it in Mexico City) and along with the required pictures and other copies, the only documents I showed were: ID Credencial de elector, expired passport, and I also had my original birth certificate with me "just in case", but I didn't need that! However, I am pretty sure they never asked me if I was married, divorced or else!

I wonder if that question is just for women that want to change their names...

Hopefully more experienced VJ's members will reply soon to your question. However, is my understanding that if your are a US Citizen, you don't need to file N600!

If your son is born in Mexico, you just need to go to the US Consulate in Mexico and register him as yours, and if you want him to get dual citizenship, he can also be registered as Mexican.

My fiancé (now my husband) hired a company (not even lawyers and expensive by the way) to fill out the papers for the K1 and they made a mistake with my two last names: the first last name is now my middle name! Yes, big mistake that I am going to fix thru naturalization. I didn't fix it before just because of all the long waiting at SS, DMV, etc.

After that unfortunate mistake, we decided to fill out the papers by ourselves, and of course, using this wonderful website VISAJOURNEY.COM things were a lot easier!! Thank you, I love this site!!
