  1. Today I received a I-797 approval notice for the I129F I filed for my fiance and there were a few things I was wondering about.

First off, it gives a valid date of 10/17/13-2/16/14- what exactly is valid?

Secondly, it says that the approved petition has been approved and forwarded to the listed consulate, but there is no consulate listed- he's English so should it say "London" somewhere, or do they mean that it's been forwarded to the California Service Center?

I'm under the weather today and not able to make sense of the guides up on this site- now it goes to the NVC? For some reason I thought that it would be going straight to his consulate in the UK. How long does it take to go through the NVC, when could we expect his interview to take place?

If anyone could point me in the right direction I'd appreciate it:)

    Thanks!

  2. Are you prepared to file a waiver when he has his interview?

Yes, we have the waiver ready, however we're worried that at the interview they'll realize that he has these convictions on his record (in the UK though, they were considered "stepped down", so they don't count against him there, they took place over 20 years ago), and that he had ticked "no" on his esta waiver. That technically is visa fraud and could get him banned from immigrating.

It's just taken us so long to get to the point where we could file for the K-1, it's been such a hard road getting where we are now. It's been such a strain be apart so long, and now it's all in jeopardy as we didn't understand what they were looking for. We're both besides ourselves with grief. We really thought that we were being completely on the up and up.

  3. My Fiance (from the UK) has visited me over a dozen time during the duration of our relationship, using the VWP. However, due to confusion regarding the moral turpitude question on the ESTA, and believing that his two previous convictions (shoplifting in 1980 and burglary + criminal damage in 1981) did not involve moral turpitude, he ticked “NO” to the question relating to criminal offences on the ESTA. It was only recently that we realised that full spectrum of crimes that can fall under the moral turpitude heading Now we have filed our K-1 application and need to know how USCIS will respond to the incorrect ESTA information error when my fiancé attends the interview at the Embassy, and presents his police records.

Our K-1 package just arrived at the drop box today, and we should be really excited that the process is finally starting, but instead we're terrified about the repercussions over the ESTA.

  4. If that was me I would put the main job and then perhaps a reference to an attachment and on the attachment put the second part time job.

Its just that there has been RFE's for overlaps and gaps in timeframes, so IMO best to include an attachment as opposed to overlapping on the form.

Perhaps someone else has a better solution.

Oh wait, you're talking about putting down more than one job? I had two jobs last year, so my employment part on the 325a does show that I had both at the same time. I just quit the main job (to look for better employment in my field) and am only working the second job. So it reflects that I only have one at the moment, but would it be a problem that I did have two at the same time?

  5. Hi guys!

My fiance is freaking out as he's mailed me his paperwork for me to put in our 129 package and he's realized that he wrote the dates in european style (date, month, year) at the parts where they ask you to sign and date the forms. The did the other dates, that could be typed in were done correctly.

Will the wrong dates cause a problem? Should he just resend me the forms? (The place he prints out his forms is only open once a week, so it's a bit of a hassle, but not really that big a deal). He wrote 28/7/13, so it's not like they'd mistake the date for the wrong month.

Thank you in advance for any information!

  7. Hi!

Sorry to be asking such a basic question, but I'm a little flustered tonight :P Could anyone give me a link showing how I find the addresses for the

United States Department of Homeland Security U.S. Citizenship and Immigration Services filing location, and the United States Consulate? He lives in the UK- so for that I think it's the one in London on Grovenor Road?

Sorry, my brain's just not working well tonight:(

  8. Seriously dude. How many time are you going to present your opinions as facts? This morning it was that F2a cannot do concurrent filing starting Aug. 1. Now this. Once again, I ask for your proof. You are just trying to present your opinions as facts.

Here is an interesting thread from a few years ago about this; http://www.visajourney.com/forums/topic/389175-vaccination-requirement-waiver/page-3?hl=%2Bvaccines+%2Bwaiver#entry5797302

Read what Daca has to say.

Thank you for posting that link! It gave us so much hope:) He too is doing it for moral reasons. Really, thank you:)

  9. It's not a religious exemption unless you can prove the longstanding religious edict. This will come down to personal or moral reasons. Just like you can't say you aren't allowed to meet for your "religion" unless it is actually one of the rare groups that do that (not muslims like people try to say every so often).

I did just find one that got approved. It took a year after the denial at interview.

Immigration is not a right, but a privilege, and the US gov does not want people with infections and diseases to come to the US and make the US population sick. This is for the health of the masses, not to punish an individual.

If you want to do this OP, for one shot that he probably already had, then it's going to cost a few thousand dollars and a year or more of your life.

Where did you find the one that got approved? He's coming from England and hasn't had a vaccine since he was 13. It was one of those six shot booters... Ever since he's had a choice he hasn't gone to doctors or taken medicine. He's been a vegetarian/vegan for 30+ years.

  10. My fiance changed his name by deed poll about 30 years ago and only has a photo copy of the original deed poll. He rang the solicitor who said that they no longer have those original records. When he applied for his passport 5 years ago he got around it by just changing his name again (to the same name) It was done at a solicitors office with a change of name form the second time- does anyone have any ideas about what he should do for that portion of the I-129 application? Will they accept second name change or is the deed poll photo copy suffifient?

  11. Oh yeah! My fiance just went back to the UK today cray5ol.gif after his 15th visit. He does get stopped every once in a while at immigration, this last time he was reminded that he only had 90 days for his visit (we wish we'd been able to spend 90 days together!). Isn't it better to show immigration that you have actually spent time together if you can? ALL of our money goes to financing our visits, but we have got to see eachother.

He gets asked what he does for a living occasionally, where he'll be staying, who he's visiting, etc. He explains that we're waiting to file the K-1 if it gets that far, but usually there's not that much hassle.
