Hello everyone I have a few questions and I hope someone here can help me to answer them.
1. When sending the marriage certificate to the embassy for report of marriage, what constitues a "certified" copy, would a black and white printout from the county clerk with the clerks stamp be sufficient?
2. How long does it take to received the needed papers back to then go ahead and renew the philippine passport under the married name.
I have a unique issue due to the fact that my wifes greencard was produced using her mothers maiden name as her middle name, however, per her customs her middle name should have been changed to her fathers last name. Since the greencard is incorrect, we have asked for a replacement with the new correct name, however, we haven't heard anything back about that yet.
Also, my wife is planning to go home on November 20th and she will be staying for about 40 days, and her plan was to get the marriage report done and then have her passport renewed while she is in the Philippines, is this a viable option? We cannot afford to go to the embassy to get it done here, as it is too far.
Last but not least, when coming back to the USA, will the fact that her current green card has the wrong middle initial affect her reentry if her new passport is correctly done with her fathers last name as her middle name. The green card has her mothers maiden name as the middle name. Will this be a problem? Or if she takes a copy of our marriage certificate through customs should this be ok until we get it resolved. We hope to have the green card resolved before she leaves, but we all know how long it can take USCIS to reprint a card...or do anything for that matter.
Please help me figure this out for those of you that have done this before.

I-693....this is really bothering me. My wife and I have our appointment tomorrow at the Atlanta field office. When filiing the I-485 I did not submit an I-693 because she came on a K1 Visa and she already had the exam within a year of filing. However, I read on one of the guides here that everyone is required to submit the I-693 reguardless of if you were exempt or not, however thats not how I interpreted the instructions on the I-485 form, which states as long as the exam was done within a year, it is still valid. My concern is, the interview is slightly our of the 1 year window for the exam, the exam was given June 9th of last year. My question is, should I be fine or what is the worst case scenario for me on this?
Her vaccination record from the exam also was check, INCOMPLETE, but it mentioned she could receive waivers for the remaining shots because she was too young to get them.
Please shed some light on the situation.

I received the following case update today. I am a bit confused, it gave me an interview date, but says its at the NBC, I live in Alabama. So I was assuming my interview would be at the Atlanta, GA field office, as its the closest, and the one for my area. Has anyone else received this same notice? Does this mean maybe they are not planning on having an interview? I am confused, anyone who can shed some light on the situation, I would appreciate it. Thanks

I sent my I485 in on January 19th.
I have heard nothing from USCIS and I have not even received a biometrics appointment yet, and its been two months. My case is still in the acceptance stage.
I called two weeks ago and opened a ticket to find put was going on with my case, they replied with a letter saying they have the application and tht everything is normal, however almost everyone gets there biometrics done within atleast a month.
Any insight on this from anyone would be great, as i am behinning to get more and more worried.

Hi, after few initial problems with filing my AOS due to underpayment of fees we finally received NOA 1 and the online system shows accepted, however the case has been on the "acceptance" stage for a month and a half now, is this common? I thought from what I have read the BIO appointment was typically set up within a few weeks of receipt of the AOS packet, I'm kind of worried and hope to have the green card before the summer is over, is this an issue I need to look into?

No, I just sent it, it's been on the first step for two weeks but the note below it says it typically takes 2 days.

I just was wondering if it is normal for the case to be in the acceptance stage for more than a couple of weeks. I read the explanation on the site, and it says th acceptance stage is typically completed within two business days, however mine has said that since January 19, is that common?

Yeah it's weird they sent it back and changed the status from rejected to accepted, like they waived the 85$ or something.

I submitted a i485 in December, on December 13, they sent me a notice saying they rejected my application for incorrect fees. They said they would be mailing all of my documents back as well. They never sent any of these documents. I initially didn't include the 85$ biometrics fee. I sent the 85$ and again they sent the same notice, with the 85$ check attached. My case showed rejected. Finally I sent the 85$ again and received the check back with a notice saying I didn't owe them any money, the check was attached. Then my case status changed on january 19, to accepted. Is it common for them to waive a fee for an error on their part? I have received no correspondence besides the returned check with a notice saying I had no outstanding balance. Just curious.

I fedexed my I485 packet overnight on monday. I am curious how long it usually takes to get the electronic notification that they recieved the application. i dont remember it taking more than a day with my k-1 packet, i am just worried there was a problem with it.

My wifes DS-3025 has a box at the bottom checked, Vaccine History Incomplete, and then it says below that the "Applicant may be eligible for blanket waiver(s) because vaccination(s) not medically appropriate (as indicated above)
Above, the boxes say are checked for 6 Vaccinations, as not Age Appropriate. I am trying to figure out what a blanket waiver is, and if I need to complete a I-693, because she has already done the medical, and it has only been about 6 months, so I am still inside of the year, and she turned over her medical records to immigration at her POE.
Any help would be appreciated.

When filling out a I-485 for a K1 Visa Marriage, would I fill out the forms with my wifes married name if me and her have married since applying for the visa, or should I continue to fill out the forms with her maiden name, which is what was used to file for the K1 Visa.
I am trying to make sure I do not confuse USCIS when they are looking for other files.
I have filled it out with our married name, but then I thought about it, just curious how others have done it.

I have a question about USCIS Form I-864, in particular part 21 of the form.
It asks to tally up the total number of household members, It asked you to included the total number of persons being sponsored, and then it also asked you to place 1 in the box below, if you are married, however, if the person you are sponsoring is your wife for AOS, placing a 1 in the box will put you at 3 total, instead of the 2.
How would we answer this question?

I will start out by saying I am very stressed with the current situation I am in, and any advice would be great.
My wife arrive in August on a K-1 Visa, we were married within 90 days, and we are now applying for AOS. Although she is here after her 90 days has expired. I have a few concerns as to what do I have to show she is here legally since her visa is now expired and we have not sent of the AOS packet as of yet. Also I would like to know how I would go about getting approved, as we currently live with my parents while I am finishing up my degree. I am stressing that this may cause my petition to be denied. I also would like to know if it is possible for my wife to travel with me to Puerto Rico, although she does not have a green card yet, while Puerto Rico is considered part of the US, as a territory, I am just curious if there is a risk of taking her there, and having a problem trying to reenter the mainland USA.
I am also wondering if after applying for AOS, is there any document that will be sent to show that her application is currently being reviewed, and she is not here ilegally.
Any answers would be appreciated.

What is this block asking for,
It says "Current USCIS Status" , and the next box says expires on mm/dd/yyyy.
My wife entered on K-1, her Visa (90 Days) Expired on 16 NOV 2011, our wedding was on 12 NOV 2011. So we met the 90 day requirement, I am just curious what goes in this box.
I am filing for AOS, but the 90 day window has already passed, does that matter for K-1 as long as we married within 90 days?

if my wifes original entry expires on nov 16th, 2011 (90 days)
we are already married, do we have to apply for AOS to avoid penalty for the 90 day period, or does getting married nulify that. i know we still need to apply for AOS, and we have not done that yet, we will ASAP. I am just curious, how the government will process our marriage, and not be seeking her after the 90 day visa is expired.

My fiances 90 days expires nov 16th, we are getting married nov 1st, i am curious what is needed to make sure she is not considered to be here illegally afterwards, does the AOS have to be submitted prior to the 16th, or just married?
I-90 - Replacement for incorrect name
in Adjustment of Status (Green Card) from K1 and K3 Family Based Visas

Does anyone know about how long it takes to receive a replacement green card because it had the incorrect name. My wife received her green card in July after her AOS was approved. We later noticed the middle name was incorrect and it has cause problems with her renewing her Philippines passport. I am just curious if she will have to go through the whole process again (bio-metrics) , seeing as the card is only 2 months old, or would they just make the correction and send the new card?
