  1. 1. You need to just apply for ROC using I-751 90 days before the expiry date of your wife's GC - some time in December. Can't file before 90 days window.

    2. One applications for both wife and child - yes one application fee and 2 biometric fees to pay. Yes they will get 10 years GC, if approved.

    3. No other forms to file except if you guys moved - the change of address needs to be filed using AR-11 (Immigrant wife & Child) and I-865 (USC), if he filed I-864.

    Try to gather all the evidence that is needed right from now.

  2. First, a little bit about my situation.

    My wife came to USA on a K1 Visa with her son. We have been married for just over 2 years and their "2-year" Green Cards are set to expire next March.

    I went to the USCIS website and found this:

    "Conditional Permanent Residents are given a Green Card that is only valid for two years. Form I-90 should NOT be used to renew a Conditional Permanent Resident status.

    Within 90 days of the two-year expiration date, Conditional Permanent Residents are required to file a petition to "remove the conditions" from their Green Card. If your conditional status was based on a marriage, you must file Form I-751, Petition to Remove Conditions on Residence. If your conditional status was based on being an investor, you must file Form I-829, Petition by Entrepreneur to Remove Conditions on Permanent Resident Status.

    Once your petition is approved, you will receive a new Green Card, valid for 10 years. After that point, the typical renewal process (including Form I-90) should be used."

    So my question is, do I only need to fill out the I-751 form for my wife and son and the conditional status will be removed AND they'll both get new 10-year Green Cards? I do not need to fill out the separate I-90 forms, correct?

    Also, is there just the 1 filing fee and 2 biometrics fees? I do not need to submit a separate filing fee for her son correct?

    Finally, I have to wait till I'm within the 90-day to expiration window before filing and cannot file sooner?

  3. ? The I-693 is supposed be to in the AOS package you sent in the first time. You will have to wait for them to send you a RFE (Request for Evidence) before you can send in the missing medicals. This will result in a delay. If you try to send them in before this, they won't get matched up to your file.

    I'm sorry, I was not clear. We did the I-693, because we did indeed receive a RFE after submitting the AOS paperwork.

  4. We received a request for additional evidence to continue the processing of my wife's AOS (I-485). Specifically, they are requesting form I-693 for both my wife and her son.

    My only question is, doesn't the medical screening and vaccination check that they were required to do before coming to America count? Why do they need a new medical screening and vaccination check?

    Is this common?

  5. You should have gotten each of them a SS card during the 90 day period when they first arrived in the US. You can now only get them an ITIN (this is a temporary Income tax Identification number from the IRS. Visit the IRS website and see how to do this. Their current status in the US is "without status." This is because you have not successfully applied for their AOS. And, yes you can get them a SS card after the AOS application is approved and each person has their 2-year conditional green card.

    Assuming I get the SS# after AOS approval, can I still claim them as dependents for 2011 tax filing purposes?

    My wife came to America (with her son) in August. We got married and applied for AOS (I-485). We have not gotten a response yet, but did have the biometrics interview). Neither of them have an SS# at this time.

    My questions are:

    1. Do they need to have SS#'s so I may claim them as dependents on my taxes?

    2. What is their current status? Conditional Resident as opposed to Permanent?

    3. Once I get AOS, can I then get SS cards?

  7. Thank you for the reply. Does it matter if she doesn't have "work-authorized immigration status" as I did not fill out that form when I did AOS paperwork?

    Also, since I have an I-485 pending for my wife and stepson, do I need to pay the filing fee for the I-765?

    Also, do I need to file for my stepson who is 9 years old? Finally, if I do not need to file for him, does that mean I can get his SS card separate from his mother?

    When my wife and stepson were immigrating to the US, I checked the box on the K2 requesting SS#'s be assigned to them.

    My wife and son arrived in the US in August 2010 and we were married that month. We have filed the AOS paperwork and await the notification for interview. In the meantime, I want to do my 2010 taxes and need their SS#'s.

    I've never received SS cards for them or any SS communications. So I'm not sure if numbers exist for them or if I need to apply for SS cards. I'm also not sure if they qualify for SS cards as I did not fill out the form for work authorization from EHS, thinking that the AOS process would go relatively fast.......

    Any advice or pointing in the right direction is appreciated.

  9. I had a few Russian scammers try to hit me on www.match.com. It was enough to get my curiosity up and google about Russian scammers. That led me to www.elenasmodels.com since they had lots of info on the typical scams. I was shocked at the difference in quality between the RUB women and American women. Still, I never figured I would ever go overseas to find someone, so didn't pursue it further until about a year later. I finally got bored and the idea popped back into my head. I ended up going back to www.elenasmodels.com and saw they had a free membership and figured wth. After seeing all the hotties that wrote to me on the first day, I was hooked and ended up getting a basic membership. Long story short, I was on my way to Ukraine a couple months later and married shortly after that. So that would be my recommendation...www.elenasmodels.com.

    I second elenasmodels.com I met my fiance there and they seem legit. Their will always be a few scammers on any site, but elenas seems to police their site very well and removes profiles when deemed a scam.
