  1. Hello All,

I am hoping to get some questions answered about my immigrant almost ex-husband's ROC:

We married in August 2011, and he has his conditional green card. November of last year, I found out that he had been cheating on me the entire marriage. This includes, prostitutes, e-mails, sex chat lines, hotel rooms and porn. We tried to work it out, but has never really tried. We filed for divorce and it will be final on November 18th. His conditional green card expires the same week. I know he plans on filing his ROC alone, I have refused to sign anything for him.

I have come to believe that he did NOT marry me for love. As he moved in with a woman and currently has a girlfriend as well. Also he never stopped his online porn, chat rooms or soliciting sex on Craig's list. I do have some proof of all of this.

    My questions are:

    Would USCIS consider this fraud?

Because of the divorce and lack of evidence that he has of our relationship, will the USCIS call me in for an interview for his ROC?

I really don't know what to do at this point. He is dishonest with everyone about everything. I even had to tell his mother about what he did after she begged me to get back with him. (he didn't tell her anything) She of course supports my decision to leave him.

    Any advise would help.

    Thanks

  2. First of let me announce that our interview date has finally come!!! July 26th is the day =)

now heres the kicker, when me and my fiancee (he's the beneficiary) completed the I-129F. he listed his daughter on the paperwork, even though he has nothing to do with her or her mother (we only wanted to be truthful). when completing packet 3 they asked to see the birth certificate for his daughter. he contacted the mother and she stated that he is NOT on the birth certificate, nor will see give him a copy... the consulate in Sydney is still requesting to see it even though he has contacted them about not being able to obtain a copy. is this just procedure? will they deny him a visa because he can not obtain a birth certificate that technically he has no legal rights to receive? we are both very worried about this whole thing... thank you in advance

  3. Hello everyone!! so me and my australian fiancee have been working on packet 3 so that we can get the interview underway, but for some reason when completeing the DS-156 (online form) when we click on continue, the form does not show all of the wording. It shows what we have typed in, but does not display any of the wording that is suppose to be on the form. I have already printed this form up once, without his info in the empty spots and it did jus fine.but now when he tries to do it, it doesnt work. it is no longer working for me either. has anyone else been having this problem? if so, how did you fix it? any information is helpful...

(p.s. all computers we have used are updated in adobe)

  4. thank you kiwibird..altough im not sure how to post on the reginal section..we did have a slight change in the situation, he found out that he is not on the birth certificate (found mom) but he already listed his daughter on the original paperwork that was sent it, what do we do now?

  5. ok, so we got the packet 3, but there is a slight problem!!!

it states that my finacee needs a certified cory of his daughters birth certificate, even if she is not immagrating with him. He has not talked to or seen his daughter or the mother since she was born and has no intention of having a relationship with her for reasones of his own. What do we do? would he still need a copy even though there is no relationship between them? if so, anyone have idea how to obtain a copy since he is no longer in contact with her mother? His name is on the birth certificate..

  6. Hello everyone!!

we recieved our NOA2 on April 28th (YAAAYYY!!!) and we are going through to see if we can get a head start on our next step, but while reviewing the NVC website, i noticed it talking about the priority date, i looked at my NOA2 and there is no priority date on it, should i be worried about this? does not having one mean that they process it according to the order they receive it? Pls, someone ease my mind about this, and my fiancees mind too!!

  7. Wait wait, let me get this straight, this all started from you being upset that she didnt say "Happy Valentine's day" who cares!!! if you truly love each other, Valentines day would be inevitable, you do not need a special day to say "I Love You"

I'm sorry for what happened, but i think maybe this is a good time to evaluate if you really love each other. If this is the case, you will make it through without that hallmark holiday.if not, its not meant to be. Her parents are only seeing her pain, and as an instinct, they try to protect her...try being in her shoes for a moment, it might bring things into perspective.

  8. hello!!

i am fairly new to VJ, but i have found very helpful information, thank you!!

i do have one question though. i have been trying to find what the average timeline is for an australian benificiary and american fiancee. my K-1 is off to the Dallas center, i live in Denver, Colorado and my fiancee lives in Brisbane, Australia. he will be going to the consulate in Melbourne.

does anyone know what the average timeline is for this specific situation? Thank you in advance!!
