  1. Hey Everyone,

    I know this has probably been discussed a thousand times, but i'm more wanting to vent than anything. I'm a bit annoyed that we got an RFE, it's almost like USCIS just wants to pick on us for being a younger couple or something like we can't have a legit marriage. We've gotten RFE's on like every step of the process we've done so far!!! Anyway, The information that I can remember sending was:

    Joint Bank statements

    A letter from my credit card saying hes an authorized user

    Sent a letter from another store credit card showing both our names listed on the account

    Proof of joint car insurance

    Copy of about 20 various cards (Christmas, Thank you cards, etc) Most showing our address and showing addressed to both of us over the last couple years some even noted Christmas 2009 2010 etc.

    Photos of us on various vacations/events etc over the last 2 years probably a total of 20 photos - Most were very noticeable where we were, Vegas Strip, Disney World Epcot ball... etc.

    2 letters signed by family/friends attesting to the fact we have a legit relationship

    Copy of 2008 Taxes (we hadn't done 2010 yet, and I couldn't find 2009 at the time so I know I can send that)

    I sent a copy of our mortgage statement showing the same address to show we live in the house - this is only in my name as my Mom co-signed the mortgage and asked them to put the deed only in my name. You can also see the mortgage coming directly from our joint checking account.

    Sent copies of both of our recent pay stubs showing the same address for both and both set up on direct deposit and even showed those direct deposits on the bank statement

    I may have sent more this is just what I can think of off the top of my head...

    The RFE states they want his birth certificate, I know we've sent this at LEAST twice before... but check we can send it again

    The other two are basically proof of joint address and proof of joint funds....

    As far as the bills, most are in my name because he didn't have credit at the time so it was easier. The cable bill can only be in one name so that can't be updated as it's on a contract, the water/sewer bill has to be in the name of who the home is deeded to, so that can't be changed. I haven't asked the electric company yet or the trash collection company, so I may be able to get it updated there but that would be after the RFE was sent, so who knows if that'll just raise more questions.

    Cant sent proof of any children as we have none.

    My car is just in my name, again the no credit thing. His car is just in his name because my Mom "gifted" it to him once it was paid off. I could probably get a letter to state so, I guess I could send copies of registration for both and send proof of the car insurance again so they know one car is mine and one is his? I have photos of both cars in front of OUR House I can send too!

    I can send the tax years 2009-2010

    I should be able to get proof of the health insurance showing both our names on it and life insurance showing each other as beneficiary, I just didn't have easy access to those and was rushed getting the info in last time.

    We just came back from a trip to England so I can send proof of that, copies of our plane tickets, eurostar tickets, etc.

    As far as additional info besides this, what else should I be sending? I mean I can send his drivers license showing the same address.. but with all the cards and everything else they probably have about 30 documented items showing the same address, we've lived here 3 years almost, i'm not sure what more they could need!? As far as the house, our realtor that helped us buy the house could probably send a letter saying we looked at houses together and he knows we live in the home together? The letters that both our family/friends sent mention the fact that we live together. I almost want to get anyone who has ever seen us together to write a letter and send it in! We've been together nearly 9 years, I hate the fact that 9 years together isn't good enough evidence!

    I know that it can be very frustrating when they do that, but they can RFE'D you as much as they choose

    the only thing you can do is to comply with what they ask for and you should be on your way, dont get too

    discouraged, it will work out :)

  2. At the time of interview for my son, the officer interviewed me as he is a minor and they usually interview the father.

    You think if I re-apply right away like next week or so, you think there is chance of getting him the visa or he will be denied?

    i think maybe they think if they issue you all the visa that you guys will go to the US and try to adjust your statues

    and not return. but still i thin it was extreme to cancel the child's visa. deny the parents but leave the child alone

    do you think you might have said something in your interview that might have worked against your son?

    either way am sorry to hear this, just try again for the boy alone.

    I have a few questions to ask before interview please

    1. Can I punch holes in the documents am sending to my SO in Nigeria and put them in a binder?

    2. Do we need an interview date before doing the medical?

    3. Do we need to schedule an appointment or can we just walk in?

    4. How much is the medical now?

    5.For affidavit of support, is it a must to include a letter from my bank or can I just include letter from my employer and my pay stubs (1yr)

    6. Is it a must for me to send him original of letters he sent to me as prove of genuine relationship?

    hi, for #1 yes

    for #2 not sure how it works in Nigeria's consulate, but here you have to get a date first.

    for #3 same answer as number #2. not sure what it cost over there for the medical.

    for #6 you can photo copy them and send those, not necessary to send the originals.

    We had our AOS interview last week, it went pretty well and I received the welcome letter on Thursday.

    My case is a bit special since my husband and I are living apart in two different states right now, so I just want to provide some personal experience for couples who have the similar situation.

    We did not get any RFEs and during the interview, the officer just confirmed about our situation and asked about our plan to move together in future.

    I think the important thing throughout the process is to be honest about the separation, provided a valid reason for the temporary separation, and have a realistic plan to move in together in near future. As long as you have strong evidence about your marriage, temporary living apart with a valid reason should not be a big problem for AOS.

  5. My wife's case is complete in the NVC and i was told they only scedule interviews during the second week of the month and there is no set standard to who gets there interview sceduled is there someone i can call or e-mail to scedule a interview for my wife

    No,unfortunately you will just have to wait until they set a date for you, all

    you can do is keep checking and pray that you will get one soon. don't worry too

    much.

  6. I will meet my fiancee again on July ,can I marry her while we are waiting for our K1 visa ?

    well yes you could marry her, but like the others have said you would have to pay

    a different set of fees, start all over again and wait all over again, is this something

    you guys wanna do? i really don't think so,my advice is to continue on the path you are on

    and marry her as soon as she arrives in the us.

  7. What determine whether you receive a 2 year green card or a 10 year green card? It is my understanding that if a couple has been married for over 2 years before receiving the immigrant spouse's green card, then it is automatically a 10 year green card...on the other hand, if they have been married under 2 years, then they receive the 2 year conditional green card, then they must file an I-751 after 2 years, and so on...

    Here's our story:

    My girlfriend and her mother came to the US in December 2004 in order for her mother to marry a US citizen, which she did. My girlfriend's mother and American stepfather were married in March 2005. They applied for the mother's green card in the fall of 2005, and received it in August of 2007 (and both my girlfriend and her mother got 2 year green cards). So should they have received 10 year green cards instead, or not?

    Obviously it matters which date the USCIS uses to measure against the date of the marriage in order to determine whether it has already been 2 years...so do they measure the length of time from the date of the marriage to the date of applying for the green card (my girlfriend's mother and stepfather were only married 6 months before applying), or do they measure the length of time from the date of the marriage to the date of actually receiving the green card (they were married for well over 2 years before receiving the green card)...so which date does the USCIS use?

    Does anybody know?

    my understanding is that they would use the date from marriage to the date the green card was actually issued

    so if they were married well over 2yrs before the card was issued then the resulting green card should have been

    a 10yr green card, not sure why they got the conditional one, they could make an infopass appointment and sort it out.

  8. Hi everyone, well I'm gonna keep it short. When my husband filed for the I 130 he sent my pics without a scarf on cos my gov used to consider passport pics with scarf illegal, but since the revolution we r allowed to have passport pics with scarf they called it "freedom of belief" Lol, so recently I got my passport with my scarf on means covered hair. So my question is when my petition will be forwarded to the NVC if they see the pics without scarf and the new one in the passport with would they get confused? Will they reject my file? Please help me out in here I dunno what to do, any advices will be helpful. Thank u all!!!

  9. Hi all, The good news is that I am making another trip to India soon to see my wife and her daughter. I am filling out the forms for IR1-CR1 right now. I have heard that we will have to submit a detailed account of how we met to the Consulate before interview. Is it true? How detailed is it? We were introduced by someone on myspace and now we do not talk to them anymore because they kind of insisted on us not getting married in my 1st trip. Do I need to give their name etc to the Consulate?

    well i think it's a choice as to whether or not you want to write a detailed

    account of your relationship and the progression. i did not write anything but

    that was just my choice. however they DID ask me the names and addresses of the

    mutual friend that introduced me to my now husband. so yes be prepared to furnish

    that information, in the event that they do ask you.

    I have a question anyone ever use those jobs engines to find employment,

    and if yes do they usually ask you to fill in your social security number

    online?? i am a bit worried about that, is it normal??

  11. Vett, no disrespect to you, but what was stated above ^^gives me pause to wonder. But in putting that aside, if she have evidence that she entered into the marriage in good faith, then she can ROC on her own with a wavier indicating that she has begun the process of a divorce. The petitioner will probably have to be the one to initiate the divorce$$$$$$,unless her husband wish to take the first step.

    P.N. if I was the USC, I wouldn't initiate anything, if you want your green card then spend your $$$$ on getting the divorce. I would feel all spent out, at this junction I would just take my $$$$$$ and go and get me some rest from this mess.

    saying what he did, things happen in life, when we enter into a relationship no one knows for sure how things are going

    to turn out, there is just no guarantee, every relationship is nice in the beginning. and this post that i did is for

    my sister, and she is a very good wife to her husband, he is just a very mean mexican man that she happens to fall in

    love with, and quiet frankly i don't think she is going to leave him, she don't have the guts to walk out on a man

    i think she is just angry and was reaching out to me. and that is why i asked the question.

  12. Vett.. how your fren dem full a issues so..? Dis is like the 3rd time this year you popping out with a question. All she needs to do is to file the paper work. Honestly I dont see her having a problem she needs to file the I-751 with the supporting evidence Birth Cert. or any child/ren born to the marriage, sworn affidavits by 2 or more people who knew her prior to or after her conditional status was granted.

    Hope others will have more to add.

    what are the procedures of removing condition on green card if the person is still married

    but separated?

    they have been married for over 3yrs and they have a 2yr old child together, she can prove

    that her relationship was bona fide, and they have been living together for the entire time

    but ever since her 6yr old daughter moved to the states her husband has been very verbally

    abusive to the child, calling her names like money and shouting at her just really treating

    her very badly. so now the mother decides that she can't take it anymore.but not sure where

    she stands as far as her status.

  14. hello guys i just want to ask about the questions that being given on the interview day from the interviewer if anyone here knows any questions that being issued from the interviewer and have an idea about this

    they can ask ask any where from 1 to 100 questions so just be prepared.

    questions such as, where you met your spouse, how long you know each other

    have you met the family, does he have kids, what kind of job he does

    where he lives, does he have siblings and so forth.

    So just had a quick question. My wife came here in October with an approved K1. We didn't have any problems with anything. So we got married in December 2010, and now we are planning on applying for her AOS. The question is that I need to fill out another affadavit of support and I'm not sure if it will be ok this time or not. My income in 2010, was less than in 2009 as we were not as busy at work and getting hardly any overtime. I don't know if I should just add a co-sponsor or try to do it myself again.

    Any suggestions? What is the process for adding a co-sponsor for this?

    yes if your income does not meet the 125% poverty guideline, you will need a co-sponsor

  16. Hey guys, im curently getting everything ready to file for my AOS through marriage. Does anyone know if we need birth certificate for the entire process? i have mine, but my husband (us citizen) doesnt have his, he was born abroad so it would be very very hard to get it..

    I am not quiet sure if the AOS works the same way, but i know that in my case and in the k1

    cases we had to provide the petitioner's birth certificate. i would think that you would have to

    provide proof of his citizenship i think it's a strong possibility that they will need to see his

    birth certificate. i am not sure if they will allow a copy of his US passport as substitute.
