  1. Hi,

I don't mean to argue with you regarding the unusual priorities that our immigration authorities seem to have developed over the last few years. I would not doubt for a second that TPS petitions may have been processed out of order in order to appease those who scream the loudest (or have beeter lobbyists). However, I am afraid that you fell prey to a bit of bad luck and misunderstanding of the process. NOA1 numbers are issued sequentially and not necessarily by type of visa. The fact that you hit a TPS approval after inserting a number that was 9000 higher than you actual number is merely a case of evil coincidence. I did exactly as you suggested and I got an employment authorization from late last year (a process that is significantly faster than I129F).

I want to believe that our country still works for Us (US citizens) and that our needs come beofre anyone else's regardless of hunanitarian reasons. Keep up your faith and, hopefully, you will be reunited with your loved one soon enough.

PS: Our own ordeal has been going on for 5 years (too long a story to recount here), we have an NOA1 dated August 10th and are anxiously awaiting what is surely the end of our process. Thankfully, we are still together and feeling better than ever about each other and Us.

I read a post last week that someone called USCIS at Vermont and and asked what date they were processing. Funny thing, they were also told that they were doing petitions dated 7/10.

You only have to look at Igors list, on this site, to see that they have processed petitions beyond your NOA1 date already and that there are petitions still waiting from 7/03. Proof if any were needed that they do not process in receipt order.

And do you really expect them to say, "yes we have processed a whole bunch of TPS visas ahead of yours". Look at the USCIS website to see the facts, that they have processed 217,093 TPS petitions since August, way more that is usual. In the same timeframe they only processed 7531 I-129F petitions. With each month since August being fewer pettitons processed since November 08.

If you want further proof, i have put my receipt number into the USCIS website, put a number in 9000 beyond my # and guess what. it is a TPS petition which was approved back in october.

The facts speak for themselves. They have had more intake of petitons than they could deal with, and becuase TPS petitons took priority, I-129F petitons were shelved (hence the mass group touch of 10/03) to allow them to do this.

The good news is that TPS receipts have dropped dramatically in the past few months, so i would hope that we will all see more movement with our petitons in the new year.

I hope that your NOA2 is just around the corner
