  1. I was told to file a 'petition for alien relative' I-130 for child of spouse unmarried under the age of 21, by an Immigration Officer, and an Immigration Lawyer. Nothing else. If I've done it wrong, i guess they'll let me know.

    The interview will be in Kansas City, that is our nearest Field Office as per question 22 on the I-130, which states which office she will apply for adjustment of status to a lawful permanent resident.

  2. I wasnt doing an adjustment of status, only a petition for alien relative... actually my american citizen husband is petitioning for her as his step child. They didnt send me any further instructions on the letter, which it said if they wanted more- there would be instructions on the letter. I guess I just have to wait and see what comes next. Hopefully it'll be as painless as my immigration was. Fingers crossed.

  3. I got the official letter with receipt number today, they DID send her file to the California service centre, which surprised me as we are closer to the nebraska one.

    We live in Kansas so the interview will be at the kansas city field office. I filed only the I-130, she is here in the states with me now, due to circumstances out of my hands. She came in on visa waiver. We filed this way on the advice of an immigration lawyer.

  4. I sent in my daughters I-130 Monday 23rd August to the Chicago Lockbox. Does anybody know the approx timeline that I should hear something back? Or what actually happens from there? From what I gather, from Chicago its sent to the nearest Service Centre, which for us should be either Nebraska or the field office in Kansas city. Is it processed in Chicago or not until it reaches the next service centre?

    Or will I know nothing at all until I get a 'Notice of Receipt'?

    PS-my american citizen husband filed for her as his step child.

  5. My american citizen husband is about to file for my nz born 16 yr old daughter. I have a 10yr perm residency card. My daughter just got here 2 weeks ago, due to abusive conditions and nowhere to go, back in NZ; i had no choice but to bring her here immediately. So not the ideal conditions to file, but after consulting a immigration lawyer he agreed it was the best course of action, however, tonight I started filling out what seemed to be a straight forward form until I came to question 14, where they ask for the arrival/departure record (I-94)number. She filled out the I-94 on the plane but they took the whole form when she landed at customs and security. So she does not have that information.

    Any ideas? I know its bad to leave ANYTHING blank of an immigration form. But if I dont have the info, I simply 'dont' have it.

  6. I am a permanent resident, with a 16 yr old daughter that lives in New Zealand with her father. Things have become extremely bad at home, her father is kicking her out and she has nowhere to go. She wants to come to live with me and obviously I need to get her here asap, or she'll be homeless, her fathers family and my family back there think shes acting out and wont let her live with them.

    My question is: should I risk bringing her here on the visa waiver program and applying for the I-130 with the hopes that she wont be 'out of status' for too long before its approved. (I think current processing times are approx 5 mths) I did that myself when I came here and had no problems, I was out of status for a year before being able to process my paperwork.

    Ideally I'm trying to find somewhere for her to live in NZ for a few months so the paperwork can start being processed first, but thats proving to be difficult.

    If this were your child and she had nowhere to go - would you bring her here and file the I-130 knowing that she might go over her visa waiver time length?

  7. I just read on another similar post about Immediate Relative Visa, could my USC husband use this to bring my daughter here as his step child? Ok really stupid question - does he have to legally adopt her, or by marrying me does she just 'become' his step child?

    Thanks for any advice.... going a little insane trying to figure this stuff out, and having a daughter asking every time i speak to her when can i come....

  8. I asked a few weeks ago about how to bring my 15 year old daughter from NZ here to the states. It looks at though if I petition for her with an I-130, it could take literally years. She is having major problems at home with her father almost to the point of violence. Last year she moved out for 3 months bec they almost got into a physical fight. In June she will turn 16, legal age for her to decide where she wants to live, shes made it quite clear to him and I that she wants to move here.

    So with all that being said I need to get her out of that situation asap when she turns 16. My husband is a USA citizen, I have been told it would speed up the process if he were to sponsor and petition for her to come here as his step child. I've also read (although it confuses me) that he can put in a K4 Visa? And that would mean she could come here 'while' the I-130 is being processed. I'm also confused about the fees, the I-130 seems to be $355 but I cant find a fee for the K4 visa, which on the immigration site says its a fiancee visa.... AAAAHHHHHHHH :wacko:

    Can somebody that has been thru this or knows about this confirm if I am on the right track?

  9. I am a 10 year residency card holder, I"ve been here 6.5 years. My 16 year old NZ born daughter wants to move here with me. Where do I start? I've tried looking thru the immigration site, but its impossible to make sense of. From what I gather I need to petition for her to come here using I-130? Anybody have a timeline on how long they normally take?

    Any tips or advice is appreciated! :-)
