im really confused about my case i send an MTR motion to reopen my case after it was denied in fub 17 this year. in aprial 8 i got letter from VSC On April 6, 2011, we sent this case to the Administrative Appeals Office for review okay its fin than yestrday i contact my Senator to chack the states on the appeal and she told me that They received the appeal from Vermont where it was filed on July 12, 2011 3 month wher my cas just siiting ther collcting dust any idea

My case was denied too and my lawyer advised me to refile. When you appeal, most time it takes long for them to make a decision. I think you should refile. Good luck.

At the uscis web sit they say the the appeal take 3 month to get decision I file my appeal in early April I'm tired of fighting with immigration it's clear that they made mistake the law is clear I dont know if I refill I have to wait on line all over again after 2 years of waiting

my vawa case was denid because of (good morael charecter) i had 4th degree misdemeanor and it was result of my ex action my attorney was surprise because in denial letter say the ( it matter of desecration ) i want thru hell with my ex my attorney told me i have very good chance at the apeal because it shouldnt be denid thy have no ground for denial my case been pending with Administrative Appeals Office (AAO) for the past 3 month now !!im just wendring if any body know what the chance for the apeal and how long it will take for decision

i did file MTR (motion to reopen) and still the VSC forward my case to AAO

the only way will force USCIS to make decision is the lawsuit so im going to give it 2 more moth than go head and file it

I am looking for advice regarding the possibility of filing a lawsuit against USCIS, and how/where to find a lawyer who would help.

The story is such:

I was married to US citizen, became a vicitm of domestic violence (no need to say - it is hell), filed I-360 (VAWA)...which is pending for almost 29 month!!!. During all this time I was not able to legally work (I-360 does not allow you to apply for work permit until it is approved), was not able to live the normal life - i suffered from clinical depression, was on medications all the time. 5 inquiry to VSC in writting

4 inquiry thru the senator every time different respond

1- Your case is waiting security Clarence that was 14 month ago

2-Your case with an officer for final adjudication decision will be mad with in 45 days (that was 11month ago

The last 2 inquiry was your case under review uscis cant not give NO date when your case will be don

3 inquiry thru CIS ombudsman and all the same BS I’m rally getting tired of that

I am a young intelligent man,i have no criminal record, I always obeyed immigartion laws, i suffered through enough already to go through all this. So...I am looking for advice on what I can do, especially about filing a lawsuit..

By the way i have very strong case never got any RFE i don’t understand i see people getting approve with less evidence than me
