  1. Like many issues surrounding all the marriage-based immigration procedures and adjustment of status, I think I've managed to get myself very confused, so let me ask some questions that may seem very simple to everyone else.

    Please comment if you know the answers.

    1.) Will Social Security allow me to change my name if my I-94 card is already expired if I show our marriage certificate?

    *I came on a K-1 visa. We got married on the 90th day, so the I-94 already expired but I satisfied the 90 day requirement to get married.

    2.) Do I need to change my name with Social Security to be able to use my married name on my AOS application?

    *A friend who works as a paralegal at an immigration office suggested I start using my married name even if I haven't changed my name with Social Security, to help prove the 'legitimacy' of our marriage. Anyone with previous experience in this?

    3.) Is it true that in some states, a 'legal' change of name is not done by Social Security but through the local court or a local government office?

    Will appreciate any informed comments.

  2. Just when I thought my EAD was coming soon... I received a Request for Initial Evidence (I-485) for the I-864 just ten minutes ago!

    Immediately I looked up Title 8, Code of Federal REgulations, Section 103.2(B)(10)(ii), which makes me ineligible for interim employment authorization UNTIL NINEY DAYS AFTER THE MISSING INITIAL EVIDENCE IS RECEIVED. The legal reasoning I get, but not the 'until 90 days after' part.

    I think that I did follow the new USCIS guidelines about submitting federal income tax returns, etc... for my sponsor and co-sponsor, and I have apparently fallen into the same hole as many of you.

    What confuses me now is the part that says I am "ineligible for interim employment authorization until ninety days after the missing initial evidence is received." So this means that my EAD cannot even be processed until 3 months after I submit what they want???

    Has this happened to anyone else who was hoping to receive his/her EAD soon? It would be great to hear your experience!

  3. Ginna I looked into it for my wife who came on a K1 and the comunity college dean told me that she is considered a non-resident for one year (after she receives her green card.)

    Some states recognize you as a resident after 6months of mong there, but may restrict you to a year as you are a non USC. Luckily for my wife, I found cheaper (non-accredited) ESL classes and she is enrolled there (2 more semesters to go!) Good Luck

  4. Hi everyone,

    Does anyone know the policy on taking degree or non degree classes in a graduate program while undergoing the AOS process? I am a teacher by profession but am not certified; I'd really like to work on that the soonest possible.

    I'm done with the biometrics and am waiting for my EAD and interview; I'm hoping that my EAD will come within the next couple of months. My K-1 expired a few months ago.

    Am I allowed to enroll in a university and what would my status be for tuition purposes (e.g. non resident vs. resident fees)?

    Any information will be appreciated.

    Background Info:

    I went in for my biometrics August 19, 2006.

    My K-1 expired on April 29, 2006, the day of our wedding - yes, we waited three months to get married but that's because we wanted a church wedding and that was the soonest we could plan for it.

    I sent in my EAD and AOS packet late (sometime late June 2006) because my husband and I went through a series of moves.

  5. Hi, I have three questoins:

    FIRST,

    Any advice on whether it is better to send in separate money orders for the I-485 (plus biometrics) and I-765 fees or to lump them together?

    I got my I-485 packet - which also included my EAD application - returned because I didn't get the fees right. I sent in a money order for $500 thinking I added all the fees correctly but I guess that wasn't it.

    SECOND,

    The heavy rains in Washington, D.C. got my entire (returned) AOS packet soaking WET! I called USCIS and they said it doesnt matter if I resubmit the same forms or make new ones, as long as they are legible. I dried up the forms and they're still legible but, of course, they don't look the same.

    Printing out new forms and making new copies of documents is no problem, but do I still get a new affidavit of support (I-864) done cause then that would take another day? This also got soaked but dried up and is still legible, only the paper is not that flat and new-looking anymore. Does that matter?

    Anyone have any comments on how pristine USCIS wants their documents?

    LAST,

    On USCIS's website it says you can FILE for the I-765 ONLINE. Would anyone with experience on this care to comment on how efficient or not this method is? I was told that I can file for the AOS by mail and it doesn't matter if I file online for the EAD or if I also send this together with the AOS.

    Any comments on filing online versus sending it through mail?

  6. Hi. I arrived last January 29, 2006 on a K-1 and my fiance and I got married April 29, 2006. That's actually 91 days after my arrival! I have not been able to put together my AOS packet yet although I have been reading up on it and preparing the forms.

    A few questions I hope someone who knows can answer:

    We used my husband's address in Arizona in the K-1 application. We will be relocating to Washington, DC within a week but have yet to find a place to stay there. With no address yet, can we use my parents-in-laws address in Chicago? (My husband lived in Chicago before moving to Arizona and his dad is my co-sponsor since my husband has not been earning the last two years, having gone back to school.)

    If not having an address yet makes my AOS application too complicated, can I just wait for a couple of weeks before sending in my AOS packet or will I get into trouble for not filing it within the 90 days? We should be able to find an apartment in the next two weeks so I will be able to give a current address but for now we are in transition.

    Will appreciate any replies.
