  1. I completely misunderstood the whole thing! Thank you all for clarifying (i feel very stupid). I thought that the AOS had to be filed by December 13th (the date stamped on his passport) or he was to leave the country on that date. He does not want to leave, we were just under the impression that he would have to if the AOS was not filed by then.

Thanks again for all of your replies.

  2. Hello everyone, I am desperate for help....Oliver got his K-1 and is now in the states. After a lovely wedding Saturday night Oct, 22, 2011 we are unsure what to do now?

Please help with any step by step instructions on what it is that we need to do from here.

I'm so afraid that we're going to run out of time....he is scheduled to leave the States on Dec 13th and I can't bear the thought of it.

Any help is more appreciated than you'll ever know.

  3. Thank you so much, I think I did almost everything just right. After all I did check my list about 50 times and I think the postman had to practically fight me for it as I was looking all over for a box cutter to open it one more time to check...just in case.

We are very much in love...you're right about that and the kids miss him terribly.

Can't wait to see him next week and spend a little quality time together before it is back to the waiting game.

Thanks again (so so much) for your reply,

    Adrienne :)

  4. Hello, I am very new to this site and to the whole process of obtaining a Visa.

My fiance an I have been together for close to 2 years now and it was on the Fourth of July of this year,

during his last stay of 3 months that he proposed to me. We have visited one another several times,

sometimes I go to Germany and sometimes he comes to America.

On his last trip to the states they stopped him in Detroit airport on his way to Kansas City and

asked him what his intentions were here in the states. Being that he is an honest man and we had no clue of the visa laws

(we assumed that you could marry whomever you want). He did have a return ticket to Germany and had every intention of using it. (we do know the laws about overstaying your time in the States). Anyhow, he toldd them that he was hoping to marry me here in the US and when they heard that they contacted me immediately by phone (I was on my way out the door to pick him up at the airport here in Kansas City) and asked me whether or not I was expecting someone, I said "yes, my fiance Oliver".

He then asked me when we plan to marry and would we be doing so within 90 days, to which I said we would do it before he returned to Germany. Oops! I really had no idea that it was a bad thing.

I asked him whether there was any trouble and he said that "No, there is no trouble but make sure if Oliver decides to stay in the States to do the required paperwork".

I told him that of course we would make that if it was needed but that he has every intention of returning to Germany because he was nowhere near ready at that time to make a permanent move here to the states.

I then proceeded to the airport to get Oliver and when everyone was coming off of the plane and no sign of him I assumed that he was just the last one off. I received a call at just that time from Oliver stating that they (Homeland Security) had detained him in Detroit and were sending him back to Germany because they believed that he had no intention of doing so on his own.

While we know the truth and we know that he would have done so, we understand that it is the law and that there are procedures for everyone to follow. We just wish we would have known it before that happened to us.

Anyhow they told Oliver that I could file for the K-1 visa and we have a very trusted friend who is a professor with the University of North Carolina, and who is married to a man from Germany as well. She was able to call her Immigration Attorney to get the specifics of what it was that we needed to do.

I have now filed for the I-129f as of December 10th, 2010, and while I do realize that it will take some time...I am wondering if anyone can tell me just exactly what to expect next....in layman's terms if you don't mind as this whole process is mind boggling to me.

    With sincerest thanks,

    A Newbie
