  1. The party is not familiar with the immigration procedures and has not been established in US yet to help him with this matter. He is a friend and i am trying to make sure he doesn't violate any of the immigration laws and leaves in good time to remain in goodstanding with BCIS.

    I assume once the quota is met, it would be useless to try for a cap exempt consideration. Does anyone know if this kind of employment would be considered cap exempt. There is currently noone in US that the position can be offered to.

  2. Hello all,

    I have a tough question for you. If a person is in US with a visitor visa B1-B2 and if this person is offered a position to be the representative of a foreign political party, can he be sponsored to apply for H1 visa?

    The party office here is assembled as "incorporation" and he will be the only employee for now until more staff is acquired. He is about 1 month away from the 6 month visitation cap.

    Please advice if you know any solid information on this type of situation?

    I received an e-mail and text this morning. Below is what it says.

    We have applied for AOS in September after K1 process was complete, received an RFE for medical, took care of it and sent back about a month ago. I thought the next step is for us to receive an interview day. But this e-mail sounds like they are skipping this step. Does this ever happen?

  4. Got an e-mail today and was assured the wrong "attorney of record" was removed from case and that there were no communication/request for evidence etc. that I have missed out because of this. Relief. !!! Those of you who used an attorney in the past for any reason, unless if you remove them after the particular case is over, they remain in the system as your power of attorney. ( I am told by VCS)

  5. If NVC and Embassy was notified to remove "attorney of record" via e-mail, how long does it take for them to start corresponding you directly instead of the attorney?

    I don't have an attorney but they mistakenly show that I do. NVC told me to send them an e-mail to remove him, but in 12 days we have the interview. Do they ever contact petitioner/beneficiary this close to the interview for anything?

  6. Mystery somewhat resolved. It turns out they NVC shows an attorney of record for me because I used a divorce lawyer 9 yrs ago, and he still shows in legal system as my power of attorney. NVC told me all I have to do it write a letter to them and ask this attorney of record to be removed. It's still unknown to me how they got a hold of that lawyer, I don't even know where he lives anymore :) Weird.

    Lawyer VJ'ers probably help shed light onto this?

  7. Consuls do background checks just like the USCIS and NVC. They have record of your previous I-130 and now they want to contact the lawyer that was part of it and want information from him as part of the background checks.

    But even though that was my first gut feeling about what is going on, the letter states " if you wish to continue utilizing the attorney of record for this case, please provide us with his/her contact information" this sounds like they assume there is an attorney of record for this current petition.

  8. Hello VJ community,

    I would like to ask if any member here has received a letter from NVC, asking for contact information of attorney of record. The confusing part of this question is that we have never used one to submit our petition.

    The letter says "if you wish to continue utilizing attorney of record for this case, please provide us with contact information."

    That's it.

    I called NVC and they told me the attorney of record's name they need, which was a lawyer that filed my I-130 petition 8 years ago. NVC said apparently consulate in Ankara needs information and cannot reach the attorney.

    Now how is it that my 129F has no mention of attorney, I checked the box where I declared I prepared the petition myself, they have an attorney of record for it? I don't understand it. We have 12 days to interview what information could they be asking for....

    I know I probably will find out once I call the embassy tomorrow, but the phone consultations are only 1 hr window in a day and that's in 15 hrs. I am curious if any of you experienced this, if there is an oversight I should be concerned of.

  9. My fiance will have his interview on 20th of July and we booked our flight for 28th of July. I feel very nervous about this, the ticket was a sweet deal, direct flight but no reschedule is allowed :( . We took a chance and we'll take the result however it turns out. All we can do is be well prepared, have more proof than you'd think they will need. It's also a plus that I will be in Ankara, if they let me inside with him, otherwise waiting outside. AP is the only thing that scares me.

  10. Kathryn has laid it it out very well. This is precisely why I am following the K1 route this time around. Back then I did not know the laws and did whatever my ex said was ok. Now I am more informed and I know how USA and laws work. Last year when we decided that we wanted to get married, we automatically ruled out tourist/student visa routes, because we had a clear intention of marrying and immigration. I recommend anyone who intends to migrate to US to take laws serious, as the consequences of not doing so can be severe and irreversible.

  11. I will have to tell you my situation: I came to US on a tourist visa. I was dating but not engaged to my boyfriend then. I was not sure if I wanted to move to US and all that. I never saw his house, his friends and his life. I felt I neded to do that before I could decide he was the person I wanted to marry. So, I have come to visit on B2 visa, then I liked it here and decided to stay to marry him.

    In essence, I really did come to check out the country and I told the interviewing officer exactly that! I told him I was not sure what my intentions were, and i cannot declare an intention if I am not sure of it. He asked why I did not return to my origin country and apply for immigrant visa, I simply told him I did not have the finances to make this happen and spent all my money at the time.

    The only thing I had to do was to pay a $1000 fine for having married while on a tourist visa, which was the fee in effect back then ( 11 yrs ago) This is an old story I know and things change all the time with laws.

    Also, more recently, a friend of mine was in a similar situation, he actually overstayed his tourist visa by couple of months, then got married to his GF who is USC, now he is removing his conditions to be a 10 yrs card holder.

    Hope these experience samples help. But remember, they are experiences, not what the law says. I don't claim to know the negative consequences one may encounter in this circumstance just because I have not heard any.

  12. Hi Tuana, below is the e-mail notification we received. One thing though, the e-mail was addressed to my fiancee, but e-mail was sent to me, not him. So be sure to check both the e-mail addresses you have provided, look in spam etc as well. Because they do not send a hard copy letter and missing the e-mail would be terrible. Good Luck.

  13. They are not sending the packet 3 home anymore, you get an e-mail with a link. When you click the link you get instructions on what to do. This was the email for me:

  14. I am also waiting for an interview date for K1. I contacted Ankara and I am told someone will review and get back with me via e-mail in the next few days after my packet 3 is looked over. I believe they publish interview dates twice a month, beginning and mid month, so we should be getting an interview date soon. Did you know you can look up schedule here: http://www.usemb-ankara.org.tr/consular/english/schedule_iv.html . It looks scary seeing all these K1s at the end of August and September. If we wait any longer than couple more months I will loose it. Good luck and please post when you get a date.

  15. Hi all,

    I am sending the package to embassy and have a question. On some of the application forms we have to fill out, the signature section says "subscribed and sworn before me..........on this day of...........at..........US consular officer............ " Does this mean we will literally sign these areas at the time of interview in front of them. Or do we sign before we send it in?

    Alos, do we fill all 4 forms, DS230, DS156k, DS156 and DS157............ It seems like 3 of these forms are non-imigrant visa applications and the DS230 is an immigrant visa application. I am confused since they have not sent a paper package instructions, just an email with this link. http://turkey.usembassy.gov/media/pdfs/k1k2_instructions_052011.pdf
