  1. ram245 getting pcc will be a bit headache because when you apply for the appointment average waiting time for any passport seva kendra is about 10-15 days... this includes surat and other PSKs of gujarat.. so you better have some spare time with you and also medical thing takes about 2-4 days to complete and a week waiting for the report so you want to have at least a month at your hand... i'm saying this because of many relatives and friends of mine have finished the process and already in the US... so if you want to consider this you can

  2. No...not in US if u are going for Consular Processing....Which part of India are u from...Bcoz, if u are from mumbai...you can complete within 2 to 3 days before the interview for the Medical & Biometrics..

    If not, make sure to get the appointment with the listed doctor in the US consulate website...check the link below...

    Eventhough it is possible to convert from Consular Processing to Adjustment Of Status and Vice Versa...I agree with the member "waitingforvisa" just for the reason in facing the hassles coming with that...India is not part of the VWP (Visa Waiver Program), so once your parents are in US, u should keep watching their Visa Clock and also make sure the F4 processing should be on time apart from the listed attorney issues...

    1 last question that came to my mind if any one can add some insight

    Is there a way i can get my medical, biometrics in usa if i am going through consular processing (ie travel to India for interview to get gc) ? this can potentialy avoid my second visit to India as getting 2-3 weeks vacation (gap between medical and interview) from work would be difficult

    When i contacted Mumbai embassy helpline about this question, they were saying we can answer when ur are eligible for getting Medical...

  4. I am here in US on H1B and I have also experience of filling 485 based on employer case. I have also family based F4 petition going on for me. Based on my experience of both employment and family based petitions, in your situation it is better for you to travel to India and appear for interview with your parents and get the green card.

    If you do decide to go for 485 please hire an experience attorney. Do not try to do this on your own otherwise there is great chance you will mess up your green card. Considering the legal fees and dual processes (one for your parents and one for you) I would still advice you to follow the first path. Hope this helps.

First, Only the Petitioner / Principal Applicant can get an Infopass appointment....Second whatever might be your present Visa Status (H1B - it is a dual intent Visa) and your parents are already in US and filing for adjustment of status, then they should inform by calling and let them know about the derivative beneficiary and you will be part of the petition during the AOS(Affidavit Of Support) / IV fee payment..

    No, Infopass will not in any way affect the processing of the case or on your current status..It is just a better option provided wherein you can meet in person to know about your case...NVC does not have this option..

    In my case my parents (ie Principal Applicant) r not in USA but in India. Is there any option that they can file for my adjustment after coming here and stil retain original date ?

    From USCIS Website "Family based categories require that a U.S. citizen or permanent resident relative file a Form I-130, Petition for Alien Relative, for you." but i would want the I485 to be tied to the original I130 filed for my mom ? Is that possible ? or its better to visit India and go through consular processing to avoid complications ?

  6. Call USCIS and check whether an Infopass is feasible to know the next steps....NVC will send your petition to USCIS to adjust status..Medical & Biometrics will be done at a local center...

    i have the similar question. in my case i am not the applicant but derivative beneficiary above 21 so my cspa eligibilty will be calculated in the interview of my parents. Assuming my parents file for my adjustment of status after getting green card how would i retain the original date and tie the Application with I130 filed for my mom ?

    Am I being derivative beneficiary eligible to get an InfoPass and inquiry further ? If yes, is there a certain stage where the case has to reach before i can get and apointment. Currently we have filled COA online but not revived any welcome letter or email from NVC.

    And most important doubt, does getting Infopass in any way affect the processing of the case or my current status as I am on H1B which techinically is a non-immigrant Visa.

    In the meanwhile can i do job here in india ??

    Or else can i apply for student visa and go to usa for masters and then when my pd gets current, i ll attend my visa interview for immigration visa... ??

    Is there any risk in both cases ??

    Because someone told me that i cant do job till i receive immigration visa...because i must be considered as a child though i am above 21...

    and i m not sure that if i go to usa on student visa, then will i be eligible for my immigration visa when pd gets current...

    If you plan to settle in USA, you should go for USA on students visa and start building your career in that direction so by the time you get GC, you are halfway on getting US degree or already got a degree. Now depending on your field of study, if you wanna get good job, corresponding Degree in USA is required. (For some fields like comp science you can add fake experince on resume to get interview and if you you perform there are chances tht you would land a good job without going through MS) rule of thumb is get a degree in the country you want to work so that you have something to say at the time of applying/switching jobs now and in future.

    Second part of this question is should you wait till you get green card and than start masters as you will get loan from govt from studying at lower interest rate after you get GC ? I would say this depends on you but speaking in terms of money avg fee for education is usa would be around 15K USD and if you get loan from India that would be around 12-13% interest rate whereas if you get GC and than get loan from usa it would be around 5-6% interest rate. So annually you have a loss of max 8% which is which is 1200 USD but if you start earning 1 year late min salary after Masters would be atleast 40K annually so its worth giving extra interest in India and taking loan than waiting for the GC. Secondly immigration through F4 is not something for which you should waste precious years especially at the start of your carrer bcz you never knw if it will retrogate again in future or it will move fast. Everything that ppl say here about date being current is just prediction based on analysis of data from past movements but there can be some events like Obama planning to use executive decision on immigration reform which can influence the movement in good or bad way so you should not wait for the file to be current and start planning to come to USA on student Visa.

    And Yes if you are in USA when file becomes current you can apply for Adjustment of Status and take the visa interview in USA and directly get gc as long as you have not aged out after applying CSPA and there is no risk in any cases it is just a different route to get GC as long as you can produce all documents that they ask.

    If you come here on student visa it will in no way affect your immigration file. Both the things are completely separate. While you are on student Visa you need to follow the rules about working limited hours at school and after you get GC you can work wherever & any number of hours that you want so no need to get confused consider. If you are asking about working in India there is no restrictions for you as you are and Indian citizen and if you think that working in India will take away your child status than that is myth bcz in USA children as small as 12-14 soemtimes work extra pocket money and almost everyone in bachelors work along with study to get their pocket money. So working in India or USA will never take away your dependent status from you.

    Source - I was at the same spot before 4 years. At that time files were moving 3 months at a time & I was two years away and many people told me that if you wait for 6-8 months you will be current but i didn't wait and that turned out to be good decision because there was retrogression and after 4 yrs I am still 1 year away and now people say it is still at least 1 year.

    Please let me know your thoughts about the following issues.

    I also got the same reply after 1 week. My pd is nov 2002.

    Can i send my DS3032 or Choice o Agent form through email before they send me anything to save time ?

    When i log in to portal, i see all names but there is no option to select payment. Is it normal ? When does this change so that i can make payment ?

    Principle Beneficiary is currently in Home Country but his dependent i.e son(me) is in US on work visa. My age is above 21 but through CSPA, I am below 21. If i decide to go through Adjustment of Status instead of Consular Processing, when should i apply for adjustment of status ? ( when we get COA or after principal beneficiary gets visa )

    I mailed to NVC regarding why our COA and other process is not started yet. I got following reply.

    "Dear Sir/Madam:

    The National Visa Center (NVC) received your inquiry regarding the
    immigrant visa petition: BMBxxxx filed by xxxx
    xxxxx on behalf of xxxxxx.

    Due to the numerical limitations on immigrant visa issuance prescribed
    by law, this petition is not eligible for further processing at this
    time. The petition will be retained at the NVC until an immigrant visa
    becomes available. The petitioner, principal applicant, or attorney of
    record will be notified when this petition is eligible for further
    processing. The principal applicant should not make any firm plans such
    as disposing of property, giving up jobs, or making travel arrangements
    at this time. For additional information please review the explanation
    of numerical limitations on immigrant visa issuance below."

    So , it says July 2002 petition is not available for processing yet because of numerical limitations.

    How is it possible that Sept , Oct gets notification??? Can anyone explain?

  9. My cousin sisters PD is 20 july 2001! So I guess she will hear something about interview soon! I will update once I get to know! But someone please help me with my query. She is on student visa here already.. any chance she can apply for green card from here.. her parents are in India! does she have to go back to india and apply for green card along with the family?     Assuming that original application was for her parents, she will be derivative in F4 category so she has 2 options..

    1. Go to India 10-15 days before Interview & get Visa along with her Parents

    No Police Certifcate required from USA but she will require Police Certificate from India for stay till the period she came to USA.

    2. If she cant/do not want to visit India during that time, she can apply for adjustment of status as derivative of beneficiary after her parents get visa. In this case also she will get green card without going to USA & she will have to go to nearby USA office for fingerprinting.....

    I had done research about this before some time as i am also in the same boat. Will have to look up the links websites but will send that in 1-2 days.....

    Also, i dont think lawyer is required for this. but than its upto u. if the person in usa can handle all the papework than u can do it yourself & if you go through a lawyer in USA typical cost would be around $1000-$1500 for all paperwork.

    Can any body help me finding answers for below!

    1. If in DS 230 mentioned by an applicant that he travel with his spouse and children but due to any reason if one or more can not travel with him what will happen can they travel separately ??

    If you change the date after visa interview, i think as long as you travel within the last day you are given at the time of interview there is no issue.

    If u want to chnage it before the interview i am not sure but i think you may need to update nvc about that.

    If anyone thinks i am wrong , please correct me.

    2. if main applicant leave the country (Resident country) what will be the process will there application be valid? if yes what will be the process to change his application number

    I think its better to come to Resident country for interview unless you are going for AOS, than its a totally different process. Please further if still not got the ans.

  11. you cannot adjust status here, you aren't the beneficiary, your mother is. you are a derivative of her petition. your aunt filed for her not you.

    siblings can file for their married siblings and children under 21. you will have to go through consular processing and be at the US Consulate with your familiy, you have to be interviewed with your mom. NVC will request the forms and documents for each family member immigrating to the US and you will all have the interview when your mom's priority date becomes current.

    that's why they gave you the student visa, immigration knows you have to return

    Thank you Aleful for the reply but the problem with consular processing is when my mom's petition opens,either my h1b application would be pending(in which case i can't return to usa if i somehow my application is not accepted under cspa or some other problem occurs) or i would be on h1( in this case also, if i m rejected under my mom's peteion, i have to go to same embassy again for getting my h1 stamped which is again very diff as they have got a very good reason to reject) so conlusion is i can't leave usa & now as u said i cant file for aos. but in form I485 it says "Ifspouse or child is in US the individual derivative may file for I485 with i485for principal applicant or file I485 any time after principal applicant isapproved, if visa number is available".

    So i thought

    Can i File I485 after my mom gets visa under the same petition that my aunt filed or my mom will hve to file again under f2 category & i will continue my stay on h1 ??

    I know consular processing is better than goin for f2a but if something goes wrong than my h1 & job will also go.

    Aleful or anyone please tell me your views because its all too complicated :( :(

    I was just going through your post and found that you are pending immigration case and still you get entry to US with student visa. my friend with same as of you applied and the visa officer rejected on he basis of pending immigration status:(.. what have you done?

    I was asked the same question in visa interview & i replied that petetion was filed for my mom not for me. I am going to go to usa for studying & will come back to india (v hve to show that for student visa otherwise v don't get one) as i hve such plans etc. but after all its all about luck, that guy beleived me & gave me visa. if some crazy person is der at the int he wouldnt give them. student visa r always risky.

  13. Since you are in the US and you want to adjust status, you would file Form I-485. You would not file a DS-230 for an immigration visa.

    I know i have to File I485. But in file I485 it says i can file only the visa number becomes available & in that also i have heard that there is a wait time.

    I am asking this question bcz my status in usa is about to expire in 12-14 months & the way it is going i don't think it will reach dec 2002 in that time. so i was wondering

    1. is there any way to file for aos now & extend may stay till pd is current ?

    I more issue is i am above 21 but eligible acc to cspa. so i want to confirm that & acc to me only way is through ds230 thats why i was thinking

    2. to send ds230 now if i can & than file i485 later when the pd is current?

    Or the only option i have is

    3. To wait till PD becomes current & than file I-485 ??

    please advice me as i m still confused a lot & i dont trust lawyers as i hve seen ppl being misguided by lawyers so that they can earn money for more years & case stays pending for all that years.

    tell us what is your exact PRIORITY DATE?? IF it is 2002 an month???

    and which form you have receive now from nvc?

    Thank you pak2002 for the reply. it shows that forum is not dead & people are trying to help each other to understand the whole system. Now about your questions.

    My Proiority date is nov 2002, category F4. So it is not current now.

    & I have NOT reveived any communication from nvc. but i know that next communication that i will receive is called "Instruction Packages (Packet 3)" (This name is generally used by people & i have read it many times in posts by vj members).

    Till yest i understood my next step as follows

    1. i am supposed to receive that packet 3 from nvc, approx 6 months before i get actual interview date allocated & this marks begining of process at NVC

    2. At that time i will send ds3032(choice of agent form) & fill out ds230-Part 1 & the sponsor is supposed to submit I 864, Affidavit of support.

    3. Than they again take 2-3 months to process & than send me confirmation, that all paerwork at nvc is done (hoping i don't get RFE) & we will notify you once your date becomes current.

    4. Than within 1-2 months, i wil get visa interview date.

    Now i was just casually going through the next document that i am supposed to send & find out that i send DS230, part1 & some other documents even if i dont recive anything from nvc. i came to this conclusion because of the folowing sentence that i found in the form from mumbai consulate

    "Your immigrantvisa petition has been approved.     "CAN I SEND DS230-PART1 & OTHER DOCUMENT MENTIONED ABOVE, EVEN IF I DIDNT GET ANYTHING FROM NVC OR I AM NOT INTERPRETING PROPERLY ???

    I will try to explain my problem in short. Please help me, iam confused.

    Application for Alien Relative (sister) (I130) filed by myaunt for my mom.

    Date Filed :Nov 2002

    Date Approved : Dec2009

    July 2012 Visa bulletin has Jan 2001 current assumin 1 month movement my Pd will become current inMy 2014.

    Now i am in USA on and will have a valid EAD card till Dec2014. In May 2014 i will apply for H1 visa so it will be complicated if i leaveUSA after April 2014. No my questions are

    1. When should i apply for Adjustment of Status(I485) as accto cspa my age would be 26-7=19 years ???

    2. My younger bro's age would be 22-7=15 years so whenshould we inform that to consulate ??

    I am not sure if we have to inform when I864 is is filled bythe petitioner or when the IV fees are paid or because i want to that my bro'sinterview is conducted wid my parents and i also get the green card at the sametime.
