  1. 1. We actually have gone back within the 12 month period partly to maintain the GC. They asked many questions at the entry point, but was not too much of a hassle.

    3. Yes, we will probably turn in the GC for a tourist visa. However, it's looking more and more likely that we would like to be back in 12 months (we just can't do it financially now). That is why we were hoping that we could get an extension. We would like to avoid the wait and cost again.

    We have such a terrible visa system !!

    Will we have a problem reapplying for a 2nd Green Card if we never ended up living in the US?

    After receiving our CR1 visa in Brazil in 2010, we went back to the US for a few weeks with the intention

    of winding down our professional lives in Brazil and eventually moving back to the US. We did not and have stayed in Brazil.

    Now, my wife's green card expires in November and we will most likely not be going back now. However, there is a good chance that we will go back next year.

    1) Is there any way to apply for an extension even if we have never lived in the US?

    2) If we return our GC and apply for a new one in a few months time, will we have problems? If we will, is there anything we can do now to minimize these problems?

    3) Any other suggestions?

  3. Ok. If they take it away, would she be denied entrance to the US on the trip, or just lose the Green Card?

    If the process were not so onerous, we would just turn in the Green card, get a tourist visa and go through

    the process when we have more certainty. One would think that the 2 years they give you to establish residency

    is for problems such as ours.

    Anyone have this problem?

  4. Hi.. we were granted the entry visa/green card in Rio in August of 2011.

    We traveled back to the US at the end of Dec/Jan and returned to Brazil in Jan. Therefore, we activated the green card. Only 2 weeks in the US.

    The job that I had expected in the US fell through and my job here improved substantially.

    We still will most likely move back to the US within the next 12 months, but right now we

    are just planning on visiting family.

  5. Hi,..my wife and originally intended to move back to the US from Brazil and were able to do the DCF filing and get a green card. However, the job I was hoping for in the states fell through and the work situation improved here. So, we are still living in Brazil, but intend to move back in the next 12 to 18 months. We want to travel back for Thanksgiving, but are not sure if we are going to have problems. The US consulate here has been incredibly vague about whether or not we will have trouble. Anyone have a similar situation or now of one like this?

    From what I understand is that you cannot leave for more than a year and you have to prove intention to actually live in the US. Other than what we say - ie, "we intende to live in the US shortly" - I am not sure how we can prove it.

    Any recommendations?

    Since last post we have gotten married and are now beginning to "build" the documents.

    One question we had: We lived together for a year in Mexico City where my wife was my a legal resident dependent on me.

    So, we will have to provide criminal records from there. However, after Mexico, we moved for a year to Costa Rica where

    neither of us were able to establish residency through my company and had to leave CR every three months and come back.

    Do we need to provide the criminal history from Costa Rica too? We were thinking that it might not be necessary since we

    were never really considered residents.

    We plan to apply in September/2011, if anyone wants to share notes.

  7. I am wondering if anyone can give us some more details on the residency part.

    I came to Brazil a year ago. After a few months I found work, but was not able to get the work permit until 10 months after arriving.

    So, for at least 4 of those months I was living here illegally; but, living/residing in Brazil none-the-less. At the end of the 10 months I went back to the US and returned with my work visa and am now legal. From the perspective of the US Embassy, am I eligible to apply for the DCF now? Or do I have to wait six months. We would really like to do this asap.

  8. Were you legally staying there before you got your work papers? On another type visa?

    Brazil's immigration laws are almost the exact same as the U.S. laws, so if you overstayed a visa you could be subject to bans.

    You could also call/email the Rio embassy about the requirement. They usually answer within a day or 2.

    Well, I have received my Brazilian work visa, so I think any bans in Brazil are no longer applicable. And we intend to go back to the US, so our stay here would be short-lived.

    But the question is, from the US embassy's perspective, can I apply for my fiance's DCF filing now? or in the next few months after we get married?

    We are going to try and file for the DCF in Rio de Janeiro, however we are unsure on the following. To file DCF, me the American, has to be a resident. I have lived in Brazil for a year now, but have only just received my work papers and therefore am only legally living here for a few days. We read somewhere that you need to be a legal resident for at least 6 months. However, we also read this is also determined on a case by case basis. Does anyone know whether or not the fact that I have physically lived here for more than a year is considered enough to be able to file for DCF?

    Can someone explain what the affidavit of divorce is that the US Consulate provides?

    I need to go to the US consulate to swear that I am divorced or demonstrate that I am single and able to get married in Brazil.

    They require a sworn affidavit of divorce.

    Do I need to bring my original divorce decree?

    What is the document that the US consulate provides? Just a document confirming that I swore to be single? What is included on the document?

    Any explanation as to how this works will be much appreciated.

  11. This discussion seems a bit old, but maybe you all are still following this. If so, we are in a similar situation.

    I am a US citizen and my fiance is Brazilian. We have been living together in Mexico and Costa Rica, but decided to move back to Brazil where I am currently working.

    We plan to get married in the next six months and apply for some Visa for the US. Is the DCF the best option? We may move to the US but are not sure. We would love a visa that gives us that flexibility.

    What was the final result of everyone's DCF experience? Any tips a year later?

    If we do decide to move back to the US would it be better to do the K1 visa and get married there? Or the married here?
