  1. Thank you for all your help everyone. My husbands visa was issued on dec 21, however due to an error by the courier service, where they were calling someone else for a week, he didnt actually pick u his passport until the 28th. Thankfully dos let me know that my visa was ready and told me to get in touch with the embassy and courier.

(they kept his passport after the interview so the embassy was able to send his passport to the courier on the same day)

  2. I was hoping if someone could tell me on average how long it takes to the embassy to send out the visa after DOS has stated that it has been issued & printed.

More specifically, we were told by DOS that my husband's visa has been approved, issued and printed but we haven't heard anything from the embassy yet and so we want to know how long you think it might normally take for us to get the visa or to hear anything from the embassy?

Any info you can provide is helpful...thank you

  3. When my mother submitted her I-864 for her brothers she received a RFE requesting the same thing.

What I did is write a letter on her behalf stating this (sometimes they just need it down in writing). Her petitions were approved shortly after.

Hope this helps.....here is the sample of the letter:

    Case Number:

    Petitioner’s Name:

    Petitioner’s DOB:

    Applicant’s Name:

    Applicant’s DOB:

    DATE

    To whom it may concern,

I, <SPONSORS FULL NAME>, am unable to provide any Tax or W2 documents for the years 2009, 2010 and 2011 (as well as for any/all preceding years) because I have never been employed, nor did I have any viable source of income during these years. I am therefore exempted from tax filing requirements on the basis of no income for 2009, 2010 and 2011. My husband, <FULL NAME>, who is also my cosponsor on this case, did file tax returns for the past three years, in which I am listed as his dependent. His most recently filed (2008, 2009 & 2011) tax documents are attached to this case, along with the signed form I-864 & I-864A forms. My income listed on the I-864 Affidavit of Support form for the years 2009 as $0.00, 2010 as $0.00 and 2011 as $0.00.

If you have any questions, please feel free to contact me at <EMAIL ADDRESS> or at <PHONE NUMBER>. Thank you very much and I am hoping for your very kind consideration.

    Respectfully Yours,

    <SPONSORS FULL NAME>

  4. Dont worry about it, as long as your father makes more than the poverty level (see Form I-864P ), he can sponsor your husband.

You will need to fill Form I-864 for yourself, and your father will need to fill out Form I-864A .

It's fine if your unable to provide tax papers for the last three years, since your only required to include a copy of your most recent tax form and pay stub as evidence. Including the last three years is recommended, but dont worry it wont negatively impact you if your unable to include them all.

This is a quote from Form I-864A instructions:

"You must provide either an IRS transcript or a photocopy from your own records of your Federal individual income

tax return for the most recent tax year. If you believe additional returns may help you to establish your ability to

maintain sufficient income, you may submit transcripts or photocopies of your Federal individual income tax returns

for the three most recent years."

"You may include evidence supporting your claim about your expected income for the current year if you believe

that submitting this evidence will help you establish ability to maintain sufficient income. You are not

required to submit this evidence, however, unless specifically instructed to do so by a Government

official. For example, you may include a recent letter from your employer, showing your employer's address

and telephone number, and indicating your annual salary. You may also provide pay stub(s) showing your income

for the previous six months. If your claimed income includes alimony, child support, dividend or interest

income, or income from any other source, you may also include evidence of ability to maintain that income."

I hope this helps and good luck on your case.
